To pick some nits, hopefully accurately (but always seeking corrections):
- I haven't taken any intellectural property rights classes (yet) and I'm not a law school graduate unless I can manage to pass another year of classes, but if there's a copyright problem with that very nice image, I suspect it would be in the use of someone else's image / images as starting points in creating the long-barreled beast (unless the starting image/images were themselves released for such a use, or created by you). Just modifying it wouldn't protect you, I bet -- on the other hand, the fact that copyright holders look asanine and petty to pursue certain technical violations, esp. ones that don't seem to harm them financially, protects us all
I'd like to think it's fair use, sure, and I think it *is* fair, but it's I think not one of the recognized categories of fair use. I could be missing something obviious, though!
- Making the image with The GIMP doesn't change anything in the legal status of the created work. The GPL affects the code of the *application program* (that is, The GIMP code itself as well as derived works) -- you can use the GIMP all day long to create artwork that is copyright to you alone, same as with PhotoShop, or a word processor, etc.
