Some months back I posted in this forum about an altercation in front of a sushi restaraunt that I was involved in. Well....this was last night on my very first visit back to that restaraunt.

I knocked down a big shot of Makers Mark right before the BG VERY slyly stole my wifes credit card out of the billfold right on our table. I NOTICED NOTHING! My wife told me to look in there b/c the BG had bumped our table. CC was gone. I made sure she was 100% sure and followed the guy outside and caught up to him opening the trunk of a BMW 600 series. I asked him if he had the card and he said he was "Johnny the busboy", I made a show out of checking his license plates and walked back to the restaraunt to confirm this, I actually apoligized for hassling him, he was very convicing. I used to bounce so if you can fool me you are good IMO. 2 guys and the manager then come storming out.

I hear:
"That guy has my cell"
"That guy has my keys"
"That guy has my blah blha blha.."

They confront him and I move back around behind him as I can see things are about to happen. I put him in a full nelson and carry him squirmning over to the grass and he nearly gets out of my grip while the 4 Kalifornians watch me mouths open not doing anything to help. I told them I could use some help and one guy fortunately jumped in and we got him on the ground hands behind the back.

He started talking more sh#t than a toilet seat about how he was 16 and lived on the street and he would give everything back if we let him go. I told him "shut the hell up, I hate homeless people. Don't open your mouth or resist or this will go very bad for you."

Cops came and the BG told them he was at the restaraunt to make a drug deal with ME and some other person who never showed. Cops never asked me my name but said the BG had a bench warrant for theft (SOMEONE EXPLAIN PLS?) and was also high and they were taking him in for that but not this theft incident.

I had a shot of Makers Mark and 4 beers in me so I did not argue it.

Manager comes out and comps the meal and invites me and my wife in for more drinks on the house.

The reason I was unarmed was that I had just got off a flight back from Texas and hadn't even got my knife out yet. The Beemer owner came out during the scuffle and yelled not to scratch his car. I should have wiped the kids face all over it but I was trying not to get myself into trouble. The guy even came out with a flashlight inspecting for scratches on his paint.
 
Bench warrants are just what they say they are, warrants issued from the bench usually at the request of a prosecutor for failure to appear to answer a charge.

Warrant was probably for a theft charge B/G had been arrested for, bonded out, had a court date set thane did not show for that court date, judge issued a bench warrant for failure to appear to answer to the charge of theft.

Or it could also be a bench warrant issued by a Magistrate Judge who held a warrant hearing and found probable cause to issue a warrant. maybe he stole something from a friend who knew him and told the judge exactly who he was, hence the positive ID for the warrant to be issued upon. Maybe videotape from a store, storeowner knows this dirt bag and took the warrant he, based on taped evidence.

Lot’s a ways a bench warrant can be issued for a charge of theft or failure to appear to answer to the charge of theft.

no, always use pavement. it works better, and you wont have to fix it!

really annoying , the police didnt want to do any paperwork, so they take him in on an old charge, no new one.
he's 16 ? , or young anyway.
one theft charge will give him very little punishment, (the old warrant) a second charge would have been a lot better as this guy really sounds like one of those thieves who later on never sees more than 30 days at a time on the street.

glad you at least got your stuff back, im sure the cops laughed at the thief trying to call you a drug dealer
 
OFFICER I INSIST ON PRESSING CHARGES.

Kid would have been really beat up bad if it were me, I would have paid cash and left and never gone back.
 
It isn't like the management expressly invited the kid to rob its patrons.

Take the free meal and hang onto the card next time.

You might get a better table if they remember you.
