When a Waiting period saved me … WA HB1240 AWB

Background; We have a AWB here, and one of the definitions is a threaded barrel on a Semi Auto.

A local shop I was browsing in Belleville WA actually sold .22 semi-auto with threaded barrel. I was like WOW! Talk to the gun counter guy and he said, we interpret the bill as NOT INCLUDED RIMFIRE .22. They convinced me. And I started the purchase a FN 502 Tactical with threaded barrel.

Excited but confused that all shops big and small don’t sell .22 semi-Auto with threaded barrel. I called 12 shop, NON agreed with Wades EastSide Guns. So I posted a thread here. Local members here also agreed that a .22 semi-auto with threaded barrel is considered a “Assault Weapon”’ under WA SB1240, punishable by a Class 3 Felony.

So I consulted with a lawyer who evaluate risk when it comes to legal language. My attorney advised me the not take transfer of the firearm. Language is too vague via. punishment.

Fast forward today. We have a 7-15 day waiting period for pistol purchase before we take transfer. I went to the shop to have a conversation with the staff of Wade’s Eastside Gun in Belleville WA. They were offended at my questioning of the bill as how they interpreted it. I ask about my recourse to stop the transfer. They said 50% restocking fee. At this point, as advised by my attorney and member of the local public in general.. DO NOT TRANSFER. And that’s what I did.

Moral of the thread. The pistol purchase waiting period here probably save my from committing a felony unknowingly. I did not take trasfer of the “Assault Weapon”

But it did cost me 50% of $740 for a FN 502. Money well spent because I’m paranoid

The law exempts 22 caliber tube feeding devices. Doing a brief scan of the law I don't see anything else that would indicate different treatment for .22 caliber firearms regarding a threaded barrel or anything else for that matter.
 
Couldn't you have taken it, removed the barrel and left it and ordered a none threaded one?
we have handgun registration here, through the King County permit department. it would still have been registered as the FN 502 Tactical model. My hands are clean & clear! even if they said No Refund, I would not have taken possession

Semiautomatic handguns with a threaded barrel of any caliber are classified as an assault weapon.

However, only centerfire rifles with a threaded barrel are classified as an assault weapon, therefore a Ruger 10/22 or a .22 LR AR style rifle aren't assault weapons.

The difference between semiautomatic handguns and rifles in the law is the law stipulates centerfire rifles whereas the law doesn't do the same for handguns.

I guess with the ever changing laws hitting the books all over, it’s best for anyone to check legality via a trusted local source before you plunk down your $$$.

I remember having an issue with an aftermarket Glock replacement barrel. When I sent it back the sellers wanted to ship me their premium threaded barrel to compensate me for the hassle. I had to decline their offer, that barrel would run afoul of the law here, too. They understood and sent me a premium non threaded barrel instead.

FIle a complaint with the Attorney General's Office. Wade's misrepresented the legality of the law to you and whatever contract you signed that you agreed to pay a 50% restocking fee is null and void.

Did you pay with a credit card? If yes, you can dispute the charge and ask for a chargeback.

I thought about all kinda stuff as I was angry, report this and that, and it filled my heart vengeance about “I’ll show them who is right & wrong” but that not me. A few hundred dollars to know not to do business there is worth it. Wade’s was once a tactical Cool gun range shop with 20-something know it all. they have lost lots of business due to the AWB, So I think they are getting desperate and ridding the line of right & wrong. I just wish they would not dragg the unknowing public down with them.

I just want people in Washington to be aware! if it doesn’t feel right…. stop and think it over.

they have a 10/22 threaded barrel on the wall right now. I guess they are going ALL IN
 
At the least, I think I would try to get an official interpretation of the law. If the store is incorrect, I would demand my money back.
they fought hard for the last 7 years, fighting against anti-Gun laws in Washington. I don’t know who there legal team is, but they are looking for a fight with the Attorney General… Good for them! risking it all

I’m not getting emotional over a lost of a few hundred dollars. anybody check there retirement account lately! lol

50 percent is highway robbery lol. Plus I think your probably right about it being a felony sadly... Man why do politicians do this stuff?? Criminals already don't follow the current laws lol. Sorry I'll leave it at that.
 
I, for one, would not like to be drug into a situation where I could be arrested, lose ALL of my guns and gun rights, and go broke paying attorneys fees, all because a FFL chooses to walk right on the laws edge with sales to customers. (Or even over the edge.)

That stuff is unethical and uncool.

I would take a pass on shopping there if I were in your shoes.

50% yes, Shop is located in a very nice tech community, so they are use to people not caring about a few hundred bucks. Just imagine if Downtown University drive in Palo Alto had a gun shop. <<< yep, it’s like that in Belleville WA.

Anywho… the Waiting period saved me!!!! if could have taken trasfer last week after the sales guy assured me of the legality, I would have, and that would have followed me forever with our handgun registration here.

No, this is not my normal shop, everything is 2020 prices. But yes, they won’t be getting a single dime from me again, but I’m sure they don’t care. The main guy was very defensive today, I know he was stuck on his ways and no way of changing anything that was against his ego!
