I have purchased probably a couple of dozen firearms from Kentucky Gun Company over the years... never a problem.. I like to use their layaway...30% down .. 90 days to get it out ..
I put a cheapie Charter Arms $325 38spl in layaway awhile back .. then life happens.. back goes out .. had to wait a month for a epidural... got back on my feet ..my son’s transmission goes out in his work truck ... I pick up the bill ..then I find out I have to have neck surgery.....
And bing ...
I remember my layaway... I email them ... everything is good still have a month to pay ...I get the amount I need .. I send PO/MO

.... Crickets ......I hear nothing.... I email twice .. I get a reply.. yes we have your payment...
But we don’t have the gun ???
I email back ... when will you get one ?
Answer.... 3 to 6 months ( turned out 30 to 90 days)
I ask them .. could you send me a receipt of my credit?
No answer..
I re-email them
Waiting on answer...

(Called them problem solved )

Personally, I'd at least want my $325 to be applicable to another purchase.
If I understand this correctly, you bought the gun on layaway and got the total payment in by the time specified and ... no gun in stock.
IMO, while the print may say otherwise and you may be legally SOL, a company that cares at all about its customers and/or a square-dealing reputation would give you a credit to be used as you see fit or your money back. And that, IMO, should be for anyone, but especially for a guy who's bought several guns from them.
I'm no lawyer, but that's what I'd politely but firmly seek. And, yes, I would get on the phone.
 
Sounds like a call would be a good idea. Remember, gun sales are crazy right now. They may be having alot of trouble getting your order. Explain your concern and give them a chance to make it right.

Yep... I was thinking the same thing .. I just don’t think I want to wait 6 months...
 
Honestly, I think the OP's circumstances justify a full refund from any seller that cares about their customer service reputation. The first missed email was a bad sign they probably don't. At this remove in time, some forceful action may be necessary: produce the item purchased NOW, or produce a full refund NOW, or a formal complaint will be filed. Be prepared to act on option three.
 
Much depends upon upon the language of the lay-away rules of the individual business, at the time of the OP’s first lay-away payment. Accepting a lay-away payment for an item not yet in stock may smell fishy, to my nose, but depending upon the local business practices, may or may not be out-of-line.

To my mind, “lay-away” means I get to inspect the firearm, then say, “I would like to start a lay-away, please.” When I pay the final payment, I get the exact same firearm I inspected on Day One. My fingerprints may have been wiped away, for protection of the finish, but the serial number, and everything else about it, will be the same as on Day One. Obviously, other places’ practices may vary.

Even well before 2020, I discovered that a firearm being shown as “available” on a prominent gun store’s website did not mean that it was in-stock, for a walk-in purchase. I walked out, and have never been back. This was a quite fancy-looking, and quite large, gun store, in an adjacent county. They did have some number of firearms inside the place, but most of their “available” firearms were at a distributor.

Just got off the phone .. super nice people... no wonder I do so much business with them !!!

It was a computer glitch ... they apologized..
Offered me credit toward another gun , a complete refund ... or let it ride .. should be 60 days at the most ... Im letting it ride ...
so no problems
 
I have done a couple of layaways. But these were items I inspected.

Have never put anything in layaway from an internet source.

Bought a couple over the web, credit card, with an inspection/ return policy. Both guns were as advertised ( one new, one used ).

CDNN has a rifle I might order. Id rather pay cash to a shop where I can inspwct the exact item, will pay more to do so ( within reason ). The stuff I like isnt fashionable ao the hype of recent doesnt ( or shouldnt ) apply.

They also call me when something I might be interested shows up.
Theyre enablers LOL
 
I think the gun sales are booming is a piss poor excuse for what they did. As others have justified.

You entered into an agreement to buy said item , not any item but the one in question and they sold that item. I would tell them to stick it up their ass and get my money back.

They broke the agreement if I understand your situation correctly.

I have delt with too many gun seller issues this year to even entertainin the thought of being understanding for anyone in that position. Deliver a product or do not take my money
