Ar15 on layaway question

I had a little money making my wallet too fat, so I go down to my licensed gun dealer and bought a M&P 15 on layaway. The total was 700 buck, I put 400 dollars down and waited till my next paycheck to pay the rest of the balance off. Today I cash my check and head down to pay the rest off. I got put on a waiting list cause something with the background check messed up. I was suprised sinc I've never in my life had to wait to get a firearm. Anyway I asked the dude behind the counter that if something goes wrong, will I be refunded my money. He said no that it's company policy that layaway purchases can't be refunded. Is this even legal?? If something goes wrong for whatever reason I'm out 400 dollars!!

While it may be their "company policy", unless you were given notice they can't keep it.

Did you get a receipt?
What does the recept say?
Is there signage posted in the store regarding the policy?


Usually a store will deduct a fee if the buyer changes their mind, but not keep the entire balance. This should be noted on any paperwork at the time of sale.

I kinda doubt they have anything in writing.;)
 
There is nothing on the receipt, there's nothing printed in the store either. They also did not tell me that they wouldn't refund my money at the time of purchase or I would never have done it
 
I'm guessing the "dude" behind the counter didn't have a clue what he was talking about.
 
One thing to remember: you may complete your purchase and OWN it, but may not be able to take POSSESSION of it. But that doesn't mean you can't sell it to someone else once you own it and have them take possession after they pass the check.
 
I've never had a problem before I've bought ten plus guns this year, usually a background check takes 5 minutes.

Ahhh, have you "anonymously" purchased a large quantity of ammunition online that no one knows about? (sarcasm off) Seriously, probably someone with a similar name. I have that problem all the time. Call the dealer back or drop back by after three business days and pick up your rifle.
 
They can't keep your $400, if you don't get something in return.
I don't care who they are.

Go back, and ask to talk to the store manager.
Talk in calm reasonable terms.
See what happens.

But in the future, do like I do.
I keep my money in the bank, or the hidy hole in my billfold.
Until I have enough money to buy something I want, pay for it, and walk away with it in my hand.

Works for me for the last 68 years!

RcModel you are very wise, you sound exactly like my dad lol. He told me I was dumb for handing another man my money without anything in return. Saturday if they don't call I can come and pickup my rifle. But I think I'm done doing business with this lgs. The staff is a bunch of 20 year old kids that aren't that knowledgable. One guy didn't even know they made piston ar's even though they had 3 on the rack behind him. I mean I'm in my 20's but I'm smart enough to listen and learn.
