"Legal" Marijuana and Gun Ownership - Lawyer Discussion

Every hurdle and barrier to the 2nd (4473, carry permit, etc.) we must argue is illegal. No compromises. The 2nd is our line in the sand.
While it's easy to champion the 2nd as absolute and unshakable, the reality is all of the amendments (excepting the 3rd) are regulated in one way or another, and our Republic has not collapsed as a result.

Frank has Chapter and Verse aplenty to so any number of reasonable, even needful, restrictions on any number of Amendments.

Now, there is legitimate debate as to whether we need 20,000 such laws and regulations; but we simply cannot make a case for no regulations at all--no matter how appealing that might feel.

Does anyone know of a case were someone was charged and convicted of a Federal crime who had a State Medical card and got caught with a gun.?

Not some felon who was caught with a firearm and assorted illegal drugs (which happens daily)

Marijuana is almost like alcohol was during prohibition . Most anyone can get it within a few days time , but most of the money goes to a foreign country drug cartel . We should just grow it like tobacco here and treat it like alcohol if you do something stupid while stoned or grow or buy illegal grown marijuana . All that money stays here .

The money spent on weed around here stays local . It's grown here indoors , and sold on the local reservation in a store . Similar to their tobacco/cigarette shops . You walk in pick out what ya want from a chart which tells you what kind of buzz to expect and the THC level . They even have gummy bears and rice krispie treats with THC levels listed . It's on a major route on the Canada border . Lived here 59 years , can honestly say I have never heard of a pot related death on that highway...heard of plenty of deaths that were alcohol related . They did not always have the weed store , but always plenty of weed coming down that highway .

I'm Oregon and legal Pot is finishing the job endless welfare checks started. The workforce here is rapidly becoming 100% useless and common sense is now uncommon. I understand pot using auto mechanics are now being held liable for shoddy work/accidents. One pothead mechanic failed to install a customers brake retainers properly and won't be long before criminal charges involving negligence are in the news. (unless suppressed by the left). Workers comp insurance is costing employers big time and terminated employees are either listed as high risk or unemployable. This info is shared so relocating is not an option. All of this is killing every and driving competent labor costs thru the ionosphere. $100+/hr Plumbers with a 2 hour minimum right now and auto shop time is $125 -$150!!! As for firearms our LGS just had ATF Scan 4473s back to 1968. Gov't access to pot credit card purchases is a no brainer.

And what about the juicer that comes in still drunk in the morning ? Your logic does not compute .

Does anyone else find the irony that the same agency "controls BATFE

So they have the control over Alcohol, Firearms, Tobacco and Explosives
Controlled drugs are really a DEA thing.
ATF was originally a tax enforcement agency. Tax collections were removed several years ago.
ATF doesn't control drugs and never has.

So why the hell isn't alcohol on the list??
You answered your own question below.

In determining into which schedule a drug or other substance should be placed, or whether a substance should be decontrolled or rescheduled, certain factors are required to be considered. These factors are listed in Section 201 (c), [21 U.S.C. § 811 (c)] of the CSA as follows:

(1) Its actual or relative potential for abuse.
(2) Scientific evidence of its pharmacological effect, if known.
(3) The state of current scientific knowledge regarding the drug or other substance.
(4) Its history and current pattern of abuse.
(5) The scope, duration, and significance of abuse.
(6) What, if any, risk there is to the public health.
(7) Its psychic or physiological dependence liability.
(8) Whether the substance is an immediate precursor of a substance already controlled under this subchapter.

https://www.dea.gov/drug-information/drug-scheduling
Many of the substances that are controlled were placed on those schedules in 1970, but were illegal or restricted long before then. Read items 1-8 that you listed above and consider the knowledge bank that existed in 1937.

Well, it used to be...sort of. Then they took it back off the prohibited list for an array of reasons.
Alcohol has never been a prohibited substance in regards to firearms.

I've wondered the same thing about the "Sovereign Citizens" movement too. Anyone purporting to be one can't legally buy a firearm in the U.S. either....but that's a different topic.
Sure they can. They can purport all day long, but as long as they provide the required gov issued photo ID, complete the 4473 and pass NICS they are perfectly legal.

Whether the ATFE chooses to enforce laws already in place or not isn't really relevant. The fact is, anytime they decide to enforce the marijuana prohibition as written, they can. Will that lead to gun confiscation and loss of ownership rights? Who knows? Seems if they were serious about keeping guns out of the hands of criminals, that would be some pretty low hanging fruit.

Isn't claiming to be a "sovereign citizen", not bound by the laws of the U.S. the same as "renounced your U.S. citizenship?" Or is something more official required?

Nobody smokes Mexican dirt weed. The money is not going to cartels. Most of it, at least where I am, is bought in a state that has legal dispensaries and is brought in by locals.

Here where I live a person can smoke weed anywhere a person can smoke a cigarette, legally .
