This country is so messed up. He will probably spend $100,000 in court now fighting law suits from the attackers family. THis country gives more rights and support to criminals and les s to law abiding citizens. That is why criminals have free reign and we have one of the highest crime rates in the world. It isn't because we have legal guns. Its because only criminals have the full legal right to use them, since they don't get caught most of the time, but law abiding citizens always get caught.

A robbery suspect was shot and killed by his intended victim outside an East Atlanta Village bar late Wednesday, Atlanta police said Thursday.

Atlanta police identified the slain man as Jamarcus Usher, 29, of the Decatur area. Atlanta and Fulton County news Police do not believe the shooting has any connection to the recent high-profile killing at a bar on Memorial Drive. The suspected robber carried a Colt .40-caliber handgun, while the gun that killed bar worker John Henderson was a 9mm, Atlanta police Detective Michael Willis said.

The killing Wednesday comes a week after Henderson’s murder in another popular hangout about two miles away, Standard Food & Spirits, sparked an outpouring of community support and galvanized grassroots efforts to improve public safety by some who say the city is becoming more dangerous.

Willis declined to name the man and woman police said were the intended robbery victims. The man who opened fire in self defense is a 28-year-old who works in the airline industry and lives in a northern suburb of Atlanta, possibly Cobb County, Willis said.

The woman he was with — they have been dating for a couple of months — is around 40 years old and lives in the Marietta area, Willis said.

Wednesday night, the couple made their way to the popular East Atlanta Village, known for its trendy bars and eateries, because they have been taking swing-dancing lessons, Willis said.

Their dancing instructor told them that one of the East Atlanta bars, Graveyard Tavern, had “big band nights,” Willis said.

“So they came down here to dance,” Willis said.

When they left the bar around 11:15 p.m., the man gave his date the keys to his Ford Ranger pickup truck so she could drive. They walked to the truck, parked in an Ace Hardware lot across a side street on the same side of Glenwood Avenue.

Inside the vehicle, the woman was adjusting the driver’s seat and mirrors when the man looked over his shoulder and saw Usher standing at his passenger window, Willis said.

Believing the man was going to beg for money, the passenger rolled down his window a few inches, Willis said. But he had a strange feeling about the man, so he grabbed his gun from the glove box and put it on his lap, Willis said.

He asked the stranger what he wanted, and noticed the man was reaching for his waistband or pockets, the detective said. Instinctively, the passenger shoved open his door, knocking the suspected robber back a few feet, Willis said. The woman started screaming.

The man got out of the truck and the suspected robber raised a weapon at him, Willis said. “When he saw that, he just started shooting,” the detective said.

The man shot the suspected robber five or six times, in the stomach and chest, Willis said. The robber did not fire any shots.

“He just got the jump on him,” Willis said of the victim. “He told me he fired until the guy was no longer a threat to him.”

Willis said the man’s accuracy was impressive. In an interview later, the man told Willis that his brother used to shoot firearms competitively and taught him to shoot.

As one could expect, the shooting left the man and his companion visibly shaken.

“He actually said, ‘I’m surprised I haven’t thrown up yet,’ ” Willis said. “He was that upset.”

Willis said he did not know much about the suspected robber. A criminal background check did not reveal any recent arrests by Atlanta police, but he might have a criminal history in DeKalb County.

Funny, I don't listen to any of the people you listed. I have experienced "due process" first hand. I got hit from behind (rear-ended) by a guy in an old junker. Him and his wife were scam artists and just happen to hit my car. Their insurance paid for me, but 2 years later they file a lawsuit for $500,000 saying I permanently ruined the wife, even though the lady was just fine and the accident was a fender bender. She never went to any doctor, she was patting me on the back and laughing at me when we were exchanging insurance. The whole thing was a sham. Luckily, my insurance company paid for the lawyer, although if I lost I be in deep sh*t. Anyhow, it settled out of court and the "due process" awarded the lying, thieving scam-artists $10,000. Guess who pays for it? You do.. With higher insurance rates. I am sure half of that went to lawyer fees. Luckily, I didn't lose anything but time and some sleep at night for 4 months. Is this what you call justice? Crap. Wait until it happens to you.

We need break-in insurance, so we can have somebody cover lawyer fees if you have to blast some SOB who decides to come in your house and ruin your life, either physically or financially.
 
Don't ask me, call it our stupid legal system. For the Lawyers, by the Lawyers. How did a woman who got burned by a McDonalds coffee win $1,000,000 lawsuit? She saw the damn coffee was hot. Anyhow, they were going to try to convince the jury I stopped too soon. They were looking for me to mess up at any time in my testimony. She also sued her own husband (the SOB who hit me) as well. We were to split the lawsuit 50/50. Funny, even after suing me and her husband for $500,000, he didn't divorce her. What a great guy :evil::evil:.

Now, just imagine the situation were you kill an intruder or a "nice man" who comes just to say hello to you while sitting in your car. If a person can sue you for $500,000 for ramming into your car, just imagine what a person or their family can do if you shoot them , just beacuse they happen to be in the "wrong house" at 3AM, or God knows whatever bogus reason they make up.
 
There was a discussion blog link in the article. I read all 77 comments. Quite an eye opener for me. I was amazed by the number of people who said things like, I don't like guns, but I'm buying one tomorrow.

The shooter was obviously well schooled. He had no misses and all the right answers. Ya gotta love it.

Last I checked, Rush, Bill O'Reilly, Hannity, all support the rights of Americans. I am not expert on their views, but I have enjoyed hearing their talk shows in the past. I hardly watch their shows, but time to time I tune in. I have lot of respect for all of them. I think the left wing nutjob who insists we stop listening to those who support our freedom and rights is here to wreak havoc on the good members of THR and Americans, in general. Stop listening to left wing socialist garbage. The country is becoming "For The Criminals By The Criminals."

Uh, no. Reread the story. The 9mm was from a previous incident. It does not tell us what caliber the guy used to end this incident.

Not in my state. We have the castle doctrine that permits us to do so without fear of a lawsuit - as long as we did not instigate the incident, which this guy, according to the story, did not.

Even what you say is true and I agree it should be 100% true, that you have the right to kill an attacker. People in this country will sue your brains out for almost anything. Now, just imagine a greedy or pissed off member of the family of the attacker who was killed. Sure, you may be in the right and you will even win the court case. However, who is going to pay all your attorney fees if they try to get you on some crazy technicality? If they bring you to court, because some greedy bastard lawyer thinks he can get something out of you, who will be there to defend you? Would you trust your life with a public defender? I don't even know if you can get a public defender for a civil case. I am talking civil court here, not criminal court. People win all kinds of fradulent lawsuits in civil courts.

exactly. castle doctrine is about criminal prosecution. the family of the deceased can and probably will sue this guy for wrongful death. And in a civil case you don't have to prove something "beyond a reasonable doubt" instead just the "preponderance of evidence".

What they'll probably do is bring out a ton of this guys friends saying how he was loved and respected in the community. people he used to work for saying how he was an honest guy and wouldn't harm a fly. Then they'll get some slick self defense expert up there who will argue that the truck owner actually initiated the violence by opening the door into the "victim" and at that point the "victim" had legal cause to pull a gun in HIS own defense, which of course led the truck owner to shooting him. But he'll try and tie it all back around that the truck owner initiated the physical confrontation by opening the truck door.

Will the "victim's" family win? who knows, I doubt it. We'll see in the next few days if the "victim" had an arrest record or a history of violence. In the meantime, the truck owner should be taking assets out of his name and starting up a LLC to protect himself from possible litigation.

Many states (including mine) have laws that provide a civil liability shield in the event that a legal shoot occurs.

It's always a good idea to know the specifics of the law in your state/town.
 
In Texas the Castle Doctrine precludes any civil action by the felon or relatives. If you are killed or injured in midst of committing a felony and its ruled a good shoot, then no civil remedies are available to the bad guy. Its written into the Texas Penal Code - no Ifs ...Ands...or Buts.
