I've been lurking here for a week or 2 - looks like a great bunch here!
Don't know how the intros go here but I'm happily "retarded" from a power company (not a WV power company). I was a pipe welder/machinist/precision millwright before I moved into turbine outage planning. I took the early out.

I had something happen this morning that I have to ask opinions on. This is a copy & paste of what I posted on another site without my intro. I got a couple of replies - apparently this is news to folks here in WV.

WV Open Carry vs. fishing carry?

I need someone to ‘splain dis to me - this morning I decided to renew my fishing license while I was in Wally World. I don’t hunt now but I used to get a hunting license anyway, just to help support the cause. The way things are now, I don’t advertise that I have any guns!

While the sales clerk was checking off stuff I noticed a spot marked “Pistol - $8” at the bottom and I ask what it was. Apparently, you’re supposed to have an $8 permit to carry a pistol while hunting or fishing in WV????!!!!!!! This is an Open Carry state! I'd just read this last night -

Naw, I didn’t pay it - I can’t see advertising anything! Anyone have any input? Seems to me that this just a way to get DGIs to admit they own one of those dirty, nasty hand guns…

(....and all I know about the things are what my third cousin’s ex-garbage collector’s second ex brother in law’s deceased step-father’s adopted great grandfather told him he read about in an old book about the Barbary Coast……)
 
Well, first of all, I wouldn't be so sure the clerk at Wally World has any clue wht he's talking about.

Maybe it's an additional fee for fishing with a pistol... I've heard of people shooting sharks and marlins before pulling them on-board. Not sure about the uses in WV...

What caliber for big mouth bass?
 
Hi Bud and welcome aboard it's always good to run into another hillbilly brother on the internet.

I'm not sure what the correct answer is to your question but I can offer a suggestion. Go to the West Virginia Citizens Defense League (WVCDL.org) and ask. There are some members there who are very, very sharp when it comes to WV rules, regulations and gun laws and they don't mind helping new posters. In the interest of full disclosure, I'm also a member there.

Now, just because I suggested you visit another site doesn't mean you should give up on this one. The pool of knowledge here is very deep on just about everything gun related.
 
I would say it is something to beat poachers. If someone is out in the woods looking for deer for the dinner table in july, they might carry a fishing rod as a cover for being in the woods, should they run into a game warden or other fisherman. The license is probably thought to weed out the law abiding from the non law abiding, because the non law abiding will not take out the permit, while the law abiding will say oh yea, I carry a gun when I go into the woods so I guess I need this permit.

Well, a quick search shows that it is in fact illegal to shoot a fish in WV, so that's not it...

Something like this was brought up in my concealed carry class..

My memory fails me but there's some law about not having a handgun while in the woods or on an ATV or something to that affect. But if you have your CC you're good.

In the state of West Virginia, it is illegal to possess or carry a firearm in the woods at any time unless lawfully hunting. (That means it's the appropriate season, and you have an appropriate license.) There is an exception built into the code for CCW permit holders that allows concealed carry for self defense purposes.

Open carry in WV is a tricky thing because of our hunting laws. The criminal code and the sporting laws intertwine in a confusing manner. And WVDNR absolutely does enforce the sporting law as written. The WVCDL has introduced a bill in the last two sessions to clarify and reconcile the sporting and criminal codes in a manner that allows OC for self-defense, even in the woods.

If you're from WV, you should already be a member of at least the WVCDL forums (http://forums.wvcdl.org) their e-mail list (at the bottom of the page at http://www.wvcdl.org) and a dues-paid member.
 
Bud, welcome to the site. I was just curious, do you carry concealed? I understand the not wanting to "advertise" but conversely it could be thought that by getting your license to carry, hunt, fish with a pistol, etc... you are helping build the case for the "good guys" who are fighting for our rights.

Just another view, from a hillbilly in western Maine :)
 
I don't know what legislative district Bud's in, but there is at least one rabidly anti-gun delegate from Southern WV. The WVCDL can steer you in the right direction for actively helping to change the screwball OC/hunting legal situation here.
 
Worrying that buying a hunting license will identify you as a filthy gun owner for when the confiscation squads start coming around is a little paranoid, sir. Especially considering that you don't neccessarily need a gun to hunt.
