Chicago's Maneuver May Moot McDonald's Case For Now

McDonald's case was remanded to the 7th Circuit.

Now that Chicago is changing its ordinances to sort of allow a handgun in the home Mr. McDonald's case might be moot and the 7th Circuit might dismiss it sua sponte.

I think it will be a long hard fight to get ordinances which sort of allow a handgun in the home ruled unconstitutional.

The real battle is at the ballot box. Illinois needs to pass a state law that municipalities cannot have laws more strict than state restrictions. New York state needs to do the same thing.

Surprise surprise-the Chicago and NYC rules make me thankful I live in New Jersey.

In Chicago you are right. Same for New York City. For now it is hopeless.

But there are a lot of patriots in downstate Illinois and upstate New York.

A state law preempting more restrictive local rules could pass. Both in Illinois and New York.

Unforunately, pre-empting home rule units in Illinois is a tough proposition, having little to do with firearms.

In the first place it takes a 3/5 vote of both houses of the GA to do so.

Like most states, local politicians like their perogatives and are opposed to giving them up unless they get something better in return. The state is so broke there is not much left to give them.

Yes, count the number of politicians in the house and senate in the state capital that come from cook county and Chicago and who are beholden to Daley and the Chicago machine for their political careers and then count how many votes it takes to get a supermajority to pass a pre-emptive state wide law and you will see that the numbers don't work.

That is not to say that people aren't working hard to overturn the Chicago machine at the ballot box - but the truth is that despite the best efforts of those involved - it is not going to happen in the foreseeable future.

Yes, it does appear that the new law will moot the case - but there are two positive points from this - some Chicagoans will be able to have a handgun and the precedent of incorporation of the right still stands. The next step will be to take this new law to court as they are doing in Heller II in DC.

Unless I miss my guess from reading McDonald and Heller in light of McDonald - the courts will ultimately throw out this law too and will require some form of legal carry for self-defense. I hope I do live long enough to see the day that Daley is forced to accept legal carry - I really believe that once that happens he will retire from office or not run for re-election.

Cheer up, guys. Daley is nearing 70 years old. He won't be around much longer, look at his father's exit back in the late '70s.

One way or another, he'll be retiring, not running for re-election, or maybe in jail if they finally get the goods on him. He'd look good in the IL Governor's wing of the WI penal system.

I just hope he is the last of his family's "dynasty", with emphasis on the 'nasty' part. LOL

I'd hate to see yet another member of the clan just happen to want to run for mayor. Enough is enough, already.

Our elected leaders and our courts will define and defend the 1st amendment and others to the death, yet bend themselves into pretzels to keep the 2nd as murky and restricive as possible and to assure that in practice it is not a right, but a privilege to be dispensed at their pleasure.

The example of what happened when Daley I died is not encouraging.

Al Capone was replaced by a bunch of Little Nicky Scarfos, who were in turn replaced by Al Capone's "slow" kid.

The operative concept is competent criminal, incompetent criminal, they're all just criminals.

There's a saying in Chicago (actually, it's pretty popular in Springfield too, at the state level):

"It doesn't matter who votes, or how they vote. What matters is who counts the votes."

It may well be impossible to get rid of the cancer that exists here, both in the state and city governments. It's too entrenched, too insidious. In case you wondered how a guy with no experience in executive or government functions could suddenly become president, Chicago is a great learning opportunity. If a certain Republican politician's wife hadn't decided to drag her divorce into the public arena, you would have never heard of Barack Obama.

Blago might give up Daley in some kind of plea bargain... Or that cop that was recently convicted of purjury and torture back in the 70's.

A few wheels are falling off the machine, maybe it will collapse someday.

The cop was never convicted of anything related to the torture stuff. Sadly, instead of being a pariah in the ranks of the CPD he is somewhat of a hero.

His recent trial on perjury charges has to do with statements he made during a civil trial over the torture allegations.

I assume this is Jeri Ryan. Are you suggesting Ms. Ryan decided to do so for reasons other than personal?

If so, we have more issues in Illinois than just firearms freedoms. Plus, I remember that both of the Ryans did not want the records released that killed Jack Ryan's election chances.
