Bipartisan Majority of U.S. Congress Signs Amicus Brief Supporting NRA's Position in Pivotal Supreme Court Case

Fairfax, Va. -- An overwhelming, bipartisan majority of members of the U.S. House of Representatives and the U.S. Senate have signed an amicus curiae, or "friend of the court," brief supporting the NRA’s position that the Second Amendment is incorporated against the states through the Fourteenth Amendment. The amicus brief, bearing the signatures of 251 Members of Congress and 58 Senators, was filed with the U.S. Supreme Court today in the case of McDonald v. City of Chicago.

Last week, the NRA filed its brief with the Supreme Court as Respondent in Support of Petitioner in the McDonald case. The NRA brief asks the Court to hold that the Second Amendment applies to state and local governments through the Fourteenth Amendment.

"The framers of the Bill of Rights and of the Fourteenth Amendment never intended for the Second Amendment to apply only to some Americans in certain places. Gun owners across the country are grateful for the support that so many members of Congress are lending to this crucial effort to ensure that the Second Amendment applies to states, not just federal enclaves," said Chris W. Cox, NRA chief lobbyist. "I would especially like to acknowledge the outstanding efforts of former United States Solicitor General Paul Clement in authoring this historic amicus brief, as well as U.S. Senators Kay Bailey Hutchison (R-TX) and Jon Tester (D-MT), and Congressmen Mike Ross (D-AR) and Mark Souder (R-IN) for their work on this important effort. This brief boasts the most signers of a congressional amicus brief in the history of the Supreme Court -- breaking the record set just last year in the Heller case."

In September, the Court agreed to consider the McDonald case, on appeal from the U.S. Court of Appeals for the Seventh Circuit. That court incorrectly claimed that prior Supreme Court precedent prevented it from holding in favor of incorporation of the Second Amendment. The NRA believes the Seventh Circuit should have followed the lead of the Ninth Circuit Court of Appeals’ decision in Nordyke v. King, which found that Supreme Court precedent does not prevent the Second Amendment from applying to the states through the Fourteenth Amendment’s Due Process Clause. As a party in McDonald, the NRA is actively involved in this case and believes the NRA brief makes a clear and strong case in favor of incorporation of the Second Amendment. Cox concluded, "It is our sincere hope that the Supreme Court will follow the Constitution’s true meaning and hold that the Second Amendment applies to all law-abiding Americans."

Chicago has had a handgun ban and other restrictive gun laws in place for 27 years. The Supreme Court is expected to hear the McDonald case in February 2010.

38 states support challenge to Chicago handgun ban

LINCOLN, Neb. -- Nebraska and 37 other states are supporting a challenge to Chicago's ban on handguns.

The U.S. Supreme Court said earlier this fall that it would hear the lawsuit four people filed challenging the city ban.

One of the plaintiffs, Otis McDonald of Chicago, said he wants to own a firearm within city limits so he can protect himself in his home.

Nebraska Attorney General Jon Bruning says he and his fellow attorneys general want the high court to protect the constitutional right to bear arms and make it clear that cities and states have to follow the court's earlier rulings.

The goal of the Illinois lawsuit is to require state and local officials to follow the Supreme Court's 2008 ruling that eliminated Washington, D.C.'s handgun ban.

Would it be possible to post a link to the Senators that signed the brief would like to see if mine did as I wrote both of them and asked them to support this case

It's in the Appendix in the brief. Looks like Kit Bond signed it but Claire McCaskill did not.

As for Texas, I don't see Ron Paul on there. Anyone know why?

Anyone know when McDonald will be argued? Also, read the brief (link is in GC70's post). Interesting that ensuring freed slaves the right to bear arms was one of the primary goals of the 14th Amendment.
 
Color me suspicious...what are well known gun bigots getting out of this? How does it benefit them, beyond a small amount of political figleaf?
 
They're rats jumping ship. They know they'll look stupid if they pledge support for the obviously losing side, and figure they can get some brownie points with the pro-gunners if they sign a token pledge.
 
I didn't see any of the usual gun-banner suspects on the list, as far as Senators, anyway (no NY, NJ, IL, MA, MD, or HI ones that I saw). Sure it is a political fig leaf as far as it goes, but if you take the cynical view (and where the US Congress is concerned, that should be the default) then the signatures on this brief represent a list of people that think they'll get more constituent votes being for it than against it. 251 and 58 are encouragingly high numbers, and the momentum is on our side.

And as far as New Hampshire, our Republican and Democratic senators signed it, our Democratic-and-politically-smart representative (Hodes) signed it, and our Democratic-and-politically-naive representative (Shea-Porter) didn't.
 
Michiganders should note than neither Stabenow nor Levin supported the measure,...though a lot of our Democratic Congressmen did.

...No surprise. Those two have never met a gun control bill they didn't like. It astounds me that in a state chock full of sportsmen and women, those two keep getting re-elected.

She let that idiot Carloyn McCarthy intimidate her into changing her position. I think it's safe to say she can no longer be considered a pro-gun politician. I'm not sure why any congress person would pay any attention to what McCarthy does, but apparently Gillibrand does.

Either they're starting to wise up, or playing political games to lure voters.

It also has to be more than a coincidence that it was 58 Senators that voted in favor of the National CCW recriprocy bill (I didn't compare the names on the CCW vote roll call against the names on the McDonald Amicus, but I'll bet it's identical).

How does Paul Clement's contribution to this amicus brief compare to his amicus contribution for DC v Heller?

Unless I misunderstood (and I ain't no lawyer) his brief for Heller stated that reasonable restrictions by state and local governments were OK.
But this brief seems to encourage incorporation. Is he in conflict with himself? Or is Clement just being a lawyer for whatever side hires him?
 
In the mind of lawyers and politicians, the right to bear arms and 'reasonable' restrictions aren't mutually exclusive.

I'll bet that a lot of the otherwise fence-sitters and vaguely anti's on the list--the ones that likely actually do have good intentions but not much in the way of smarts--figure that it may end in a compromise. Sure, every state has to allow firearms of all sorts, but maybe that means that every state can plant restrictions on buying, transferring, or trying to register them, too.

On that note, I'm very happy to see so many poli-ticks from Florida (my current state) signed, and utterly amazed that so many from Illinois did, too. I had started to honestly feel that every one of them there were under the thumb of the crooks in Chicago.
 
Get those other lazy Senators and Congressmen to sign on. I just got done calling all offices that signed and thanked them. I also called and "informed" the ones that didn't that this was out there and they should sign on immediately.
