Is Philiadelphia really this bad?

The really strange part of this attitude is,,,,, a felon would not advertize he had a weapon by carrying open anyway...he would have to be a total idiot...also, he wouldn't have a proper holster either.

Maybe to you but it is not irrelevant to the cop who is trying to do his job, protect others and stay alive in Philadelphia.
If THAT is how he's "trying to do his job", he needs to quit, NOW.

He's every bit as useless as a fireman running around ordering people to keep piles of oily rags and open cans of gasoline in their basements.

And his job is most certainly NOT to "protect" anyone who doesn't have a police protective detachment of some sort. Police "protection" of individuals is a fairytale.

Why would you want to open carry in Philadelphia?
1. You open yourself up multiple times to getting killed by thugs who will hit you from the rear because they want your weapon.
2. If someone has something against you or wants to rob you they will just shoot you first.
3. The police have it tough enough, why would you want attract this type of attention?

Just because it is legal don't make it smart....
Can you cite one instance where this is proven to have happened? Typical strawman arguement by antis and fudds.

I don't believe for one second that the cop didn't know the law. As already pointed out there is a pending civil suit where multiple people with legitimate out of state licenses where treated to this same kind of professionalism, but also arrested, interrogated for hours on end, and had their guns taken and NEVER returned. After it came to light that they were operating within the law the mayor made a statement that while they don't agree with the law, it will be upheld until changed through congress and all police will be made aware of the gun laws of this state.

It is my belief that this cop tried to convince the gentleman what HE wants the law to be. There are news articles one after another of the PPD abusing their authority all the time. I don't remember the article right now, but an officer was quoting that they do not want people to open carry in their city and that if he sees it that they will be detained and possibly arrested until they can make sure said person has a LTCF. Absolutely sickening!

I only go to Philly for the VA hospital and about once a year to take the wifey to a play.

As citizens, we're always told that in regard to the law, "Ignorance is no excuse." That goes both ways.

These fellows should no longer be wearing badges. I sincerely and fervently hope that this guy sues the Philly PD, and takes them for as much as he can. Sad thing is, it comes out of our money.

It worked for Richard Banks, the founder of PAFOA. The Dickson City PD eventually settled for an undisclosed sum.

My apologies, he is the founder of PA Open Carry. I remember reading over there that it had been settled, but apparently I am mistaken. Once again, I apologize for any confusion.

Gotta love that Philly "accent," they always sound like they have about four pounds of Geno's chessesteak with Cheese Whiz in their mouths ... and I'm FROM the Delaware Valley!

I am very surprised that he was not charged with felony wiretapping for making an audio recording without the consent of the officers involved.

Philadelphia politicians and police take their cues and orders from across the river, not from the state capital. Need I say more?

Typical Philly

Cop probably got his job because his dad or uncle was a cop. Or his family made some campaign contributions.

Remember Philly almost lost WWII for us when the city transit workers went on strike not for more money or poor working conditions but because the city wanted the company to hire African Americans for transit system workers.
There was a manpower shortage at the time. The Army finally forced the company to hire African Americans and the supplies and equipment made it to the troops. If the strike had continued who knows.

Some cops have very interesting pysch profiles. They like things black and white and no gray areas or they like having the power to make folks' days interesting.

Worst LE out there despite the TV show is NCIS who only got arrest authority in early 2000's. Before that base police or other LE had to make the arrests. Read about their conduct during the Tailhook investigation its makes Deputy Fife look competent. SA who interviewed the victim asked her out on a date and SAs at Cherry Point faxed from their office fax photocopies of their packages to Congress woman Patricia Schroeder. Back in the mid 80's admiral in charge of NCIS a Navy Seal spent thousands of man hours investigating Seal Team 6 for fraud because he and CO had issues.

There are good cops and bad cops. Treat me with respect and you get the same.

Possibly for phone calls. If you're having a discussion in public, I don't see how you could make that illegal... especially when a public servant initiates the conversation with you. It would be silly, IMHO, to have any sort of reasonable expectation of privacy when talking to a LEO on a public street.

No way. Here in Detroit we take serious pride in our level of corruption.

Oh yeah! How many of your former Governors are in jail? HA! Illinois takes the cake! (and then sells it illegally for political gain) You got nothin' on Chicago!

Governors are state, not city. Right now we have the former mayor in jail, his right-hand woman just out of jail, a city council member in jail, the ex-mayor's father was just indicted and will probably go to jail along with a bunch more of the mayor's friends and city contractors. For a city of less than a million people, Detroit has no equal.

Philadelphia has beautiful buildings, some excellent history -- well presented!, great museums of many kinds, restaurants I always like visiting, and some friends of mine. However, three years of law school was plenty to know that it's not a city I want to live, however much I enjoy visiting. There are plenty of nice and interesting folks there, but the filth, violence, and pervasive rudeness (not to mention taxes, terrible parking, the perpetual Schuykill traffic jam ... ) mean it's not for me.

That said, most cops I ever *personally* encountered were neutral and professional in the contexts I saw them. Enough horror stories, including other instances of harassment of citizens recording their actions, didn't leave me rarin' to be the one getting my camera taken.

At least there are plenty of lawyers around if you need to file a suit ;)

This infringement of rights will only get worse if citizens are apathetic and do not call them out on these types of abuses with a lawsuit. I predict the City will settle to avoid more publicity on this than they already have. It also seems like this citizen unwisely but legally and maybe profitably set out to snare an ignorant cop into a lawsuit. I applaud his efforts to educate the police force on the legality of open carry. It shouldn't be left up to stunts like this but maybe he makes it a little safer for the next legal citizen to walk the streets without getting forced to the ground at gunpoint with a uniformed maniac screaming that he is going to kill you. $100,000 should educate most forces that their officers need to read the constitution and the laws they swear to uphold.

I don't care why he did it. It wouldn't have happened if the cop didn't wrongly take the bait

Total lack of professionalism and the officer failed to do anything in his job correctly.

He didn't know his job.
He didn't know the laws.
He didn't know how to properly deal with people.
He had no communication skills above HS bullying 101.
He didn't know how to listen to the person he was dealing with.
He was completely hypocritical.
He misused his position of power AND
he sounded like a complete jerk off.

He failed to possess a single trait required to be a professional in ANY job. Period. Whether this is attributed to the Philadelphia PD, just the individual, or both, I don't know. But it doesn't matter, because that officer should not be one right now.

i have a simple solution to the problem, STAY AWAY FROM PHILLY! its full of jack booted thugs and it is a city that strips every american of its 2A rights.

i dont see anything special to go into Philly unless i wanna see the Constitution up on display. Philly is a 3rd world country controlled by tyrants!

The audio recording has made news on forums everywhere. Nearly every civil and gun rights organization has discussed it, leading to a big black eye to PPD.

Thus, the PPD sought to retaliate and charged him recently. Interesting that the PA State Supreme court has already ruled that disorderly and reckless behaviour cannot be held against merely open carrying. They've already ruled that open carrying is not RAS for a stop. Harassment charges to try to stop the civil suit, most likely and to bleed his wallet and threaten his employment. They are also charging him to target his LTCF to prevent him from carrying at all in any manner in Philly.

Before, Mark had a problem with lawyers. Took quite an effort to find one willing to work for contingency, he posted. They said he had a case, yet his damages were neglibible and it wasn't going to pay enough to be worth taking on contingency. Now, after retaliatory charges and a day in jail, he can prove more damages.

Viper was charged with disorderly conduct, and reckless behaviour. When 5 police officers went to his place of work a couple days ago, he arranged with his attorney to turn himself in. It took about a day for him to be released on bail, and his prelim hearing is scheduled for next friday.
