There's a huge difference between what would happen in Texas v/s New Jersey.

The only generalization is that you cannot generalize.

Willie is correct, depends on the state. In NJ ,even a police officer would have his gun taken in the event he shoots someone to protect his own life ,most places in FL won't take your firearm unless there is something questionable in a self defense shooting. Also there is a legal term called "Totality of the circumstances" that controls much of what happens at crime scenes.
 
I was a California Police Officer and shot a rapist fatally after he tried to stab me twice after raping a old woman and trying to escape through me. As soon as CSI arrived on scene they took my revolver and my flashlight as evidence. The flashlight was used to fend off the attacker. After the coroners results were filed and the DA ruled self defense the gave my issue gun back and I retured the Dept. loaner.
