Denied lost license replacement LTC in Georgia

Looking for any recommendations--

I recently lost my wallet containing a Georgia Weapons Carry License. Pursuant to state law, I reported it lost to the issuing probate court (Gwinnett) and asked for a replacement. I recently have moved to another county (Dekalb). The state law specifically states that the issuing court must take the loss notice and must issue a replacement license. There is no provision in state law to "change address" for a LTC here.

The Gwinnett county probate court refused to issue a replacement license and states that I must re-apply, pay the full new application fee, and restart the application process and background check in my new county. Neither county will issue a temporary license, so I am barred from carrying for the 3-5 months that it will take to issue.

Does anyone have any ideas here? The state law regarding lost permits and re-issue is pretty clear, and I don't feel that the probate court is following it.
 
Taking them to court might take more than the 3-5 months to apply for a new license.

As BSA1 sez, a call/letter to the state AG might get a faster response, if the AG can clarify things for the county offices. Still, that might take more time than you want.
 
My guess was that it would be more cost-effective and take less time to just re-apply. I'm a little concerned that Dekalb will tell me that they will not issue if I already "have a valid license" though.

I suppose I'll just go down to the Dekalb probate court and re-apply and see what happens, but I do hate having to do this process since I already "have" a license with a few years validity left on it. It's my understanding that Dekalb takes "additional" time to process because they really don't want to issue anyway so they drag it out as long as they can.
 
get a photo copy of orig and file the lost notice with the new county.if any grief,file a complaint with the inspector general who oversees that section,and the state ethics commission.plus your state senator/congressman.
 
I find it strange that there is no provision for a change of address, but I agree that simply re-applying may be the best route in your case. Unless you are in a really bad area, it seems unlikely that you will be attacked in the meantime.

How long ago did you move ?

Is your mail being forwarded? If so I would have asked for the re-issue and once in possession, submit a change of address. Two step easy process but I don't know what your time frame was...
 
I'd print up the law and show it to them. If they still refuse contact your State Senator's office. I've contacted mine a few times when dealing with State agencies. They cleared my issue up pretty quick.
 
I have just moved to temporary quarters while my new home is built. I am not changing the address on my DL or CCW until I get to the next address. The temp time is 8-9 months. All addresses are in the same county.
 
You are mistaken about DeKalb dragging out the process. It took no longer there than in Fulton, in my experience. Applying in the Probate court downtown and fingerprinting in police headquarters on Memorial was a bit inconvenient, though.

Good luck with what should be a simple replacement.
 
I found the wallet, so the issue is moot now. I am still unhappy that the probate court refused to follow the law--which states that the issuing probate court is to replace it for $6.00. It makes no mention of whether or not you have to still reside in the same county. There is no requirement to change address, nor any method of doing so.

It is still a problem here in GA that while the CCW license is a state license, it is issued by the county probate court and each probate judge "interprets" state law differently. I was told by the clerk (who was very polite and helpful) that she referred the issue to the judge because it was an unusual situation and was told that the court would not re-issue a license to a non-resident of the county under any circumstances.

I moved a couple of years ago and there is still three years validity on the license so I did not want to pay the full price and wait months without being able to legally carry.

I agree that the county issued systems can be a pain in some states.

The Florida method works well, and is simple and direct. All licenses ,resident and non resident, are issued through the Florida Dept. of Agriculture in Tallahassee. The politics are eliminated.

And I'm very happy you found your wallet. I had mine stolen once many years (12-23-1962) ago and the memory of the misery of replacing all the documents and credit cards still lingers. :(

I constantly pat my right rear pocket even after all these years. The paranoia also still lingers! :D
 
My wife and I save a copy of our CCW, hunting, fishing and trapping licenses as well as Alabama Driver's Licenses to our computer. That way if they are lost we can print out a copy at will. While we can't exactly duplicate the DL and CCW, we at least have proof that we have a valid one.
