82 year old woman convicted of attempted assault

WACO, Texas Dec 7, 2005 — An 82-year-old woman has been found guilty of attempted assault on a peace officer for trying to hit a Sheriff's deputy on the head with her cane in August.

Ester McCullough was found guilty by a retired judge during a nonjury trial.

Defense attorney John Hand said McCullough fired a shot into the air to scare away one of the neighbor's dogs. Hand said the two neighbors have been involved in a dispute for about seven years.


The deputies said they were talking to McCullough outside the house to try to find out where the gun was when she tried to go back inside. One deputy grabbed her leg, forcing McCullough to hop around on one foot.

She complained that the officer was hurting her hips, which had been surgically replaced, and tried to hit him on the head with her cane. Another deputy deflected the blow with his hand.

Hand said McCullough had been willing to plead guilty to misdemeanor charges, but prosecutors sought the felony charge.

"If there is a gun involved and she is threatening to kill people, I don't think that is something that should be taken lightly," Brady said. "I think this woman is cantankerous."

McCullough has a previous misdemeanor conviction for deadly conduct, which also involved a gun, according to court records. Hand said she shot a hole in a car when her daughter's boyfriend caused a disturbance an refused to leave.

A prosecutor recommended that McCullough be placed on probation for three years and fined $400. She'll be sentenced when a background report is complete.

She scared off a dog and some guy that refused to leave, Dont see a prob.
 
It's her culture.
Brought up in a different time and place where it was the thing to do to scare off dogs or git the rascals (boyfriend) to get out without killing. She didn't get to be 82 by being meek.

Also if grabbed onto and held, the 82 year old did what was natural and that is try to bonk the holder on the head with her cane.

Right or wrong thats where she comes from, its her culture makes her do these things.

But we can make no allowance for her, she is not a government approved victim.

Age is not an excuse to act like an ass and go shooting at everything that ticks you off. The article didn't say the dog was doing anything malicious. It did say she was in a feud with the neighbor for years. That sounds suspicious to me. If a hotheaded 25 year old like myself can find another way of resolving issues than shooting my gun off, I'd expect an older, wiser person to be able to do the same.

She shouldn't have tried to hit the cop either. Right or wrong, 28 or 82, that's a big no no.
 
I just wonder what the other LEO's said when these 2 deputies brought granny in and booked her. They had to be totally embarassed.
She took a shot at her daughters boyfriend? That's a crime?

It's a form of arrest. If she wasn't read her Miranda's post haste she had a case right there. If she was going in to call counsel, again her case. If she felt she was in danger of injury because her leg was grabbed, then again she has a case.

There isn't ANYWHERE that teaches it's ok to arrest someone by grabbing their leg and making them hop, and it's unconcienable to do it to an 82 year old woman.
 
A couple questions.

When did she threaten to shoot anybody? The cops couldn't verify the presence of a firearm while they were questioning her.

Why did this Barney Fife grab an old womans leg? Is this some super secret ninja skill I haven't heard of yet?

The boyfriend was trespassing (refused to leave) and causing a disturbance. Probably not smart to go blasting for something like that, but given the age (82), how long ago was this? Her daughter had to be young enough to be bringing boys around moms place, probably forty years ago and it's getting drug out of the closet to make a point.

Sadly, I think I get the point. :fire:

Nonjury trial...when did these begin happening?
 
Non-jury trial? By a retired judge?

There better be a whole lot more to this story than what we're getting from the AP.

LawDog, didn't the last Haliburton appropriations bill backed by Dick Cheney and a secret cabal in Texas abolish the right to jury trial?:D

It works like either A or B:

A. Defendant waived jury trial and went bench (for a host of possible reasons). Retired judges are usually called "senior judges" they work part time and fill in for guilty pleas, statuses, or bench or jury trials while the elected/appointed judge is off at a seminar or meeting or working in his office.'

B. In some states, Defendant must request a jury trial for a misdemeanor with a certain time period. Maybe Grandma Kickbutt did not request a jury trial in time?

Obviously a woman this spunky must be a Yankee transplant!:D

Maybe canes would be a great gift idea this Christmas for those poor defeated Tejas LEOs?:D

Who is Brady? I don't see anything in the original article where grandma threatened to kill someone, but this Brady (campaign?) person is accusing her of doing just that.
