Hi. Is it unlawful to carry a detached 91/30 mosin nagant bayonet on your person and does it qualify as a club?

Quoted from the Texas penal code:
Sec. 46.02. UNLAWFUL CARRYING WEAPONS.
(a) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun, illegal knife, or club if the person is not:

(1) on the person's own premises or premises under the person's control; or
(2) inside of or directly en route to a motor vehicle that is owned by the person or under the person's control.

A club is defined as such:
Sec. 46.01. DEFINITIONS.
In this chapter:
(1) "Club" means an instrument that is specially designed, made, or adapted for the purpose of inflicting serious bodily injury or death by striking a person with the instrument, and includes but is not limited to the following:

(A) blackjack;
(B) nightstick;
(C) mace;
(D) tomahawk.

I really Wouldn't try it. Law enforcement could make the case that it is either a club, or a knife. If you were just transporting it that would be fine, but I wouldn't carry it around on a regular basis.

Carrying a mosin bayonet is kind of creepy too :neener: Those things are huge.

My take is that it cannot be a club - it is a stabbing instrument, not a striking instrument.

Really, if you were to swing a 91/30 bayonet, it would be pretty ineffective.

Why?

The bayo may not be considered a club, but your Mosin is !!! If only you could ask the multitudes of German soldiers who died in Stalingrad & the eastern front how they knew this.

Forgive my poor attempt at humor. I'm not bashing your fine rifle. I'm a huge Mosin fan & adopted parent of the 2 below.

I would be more concerned with the definition of an Illegal Knife, than a club. I am sure that in all that TX legal code there is something about where and when a person can carry a knife, even one that large. But why? I mean other than you can, well maybe...
