Acquaintance's Son Shot - Possible Recourses?

I know, this is not a forum for legal advice....but I would appreciate ideas of things that may be done, avenues that might be pursued.

Acquaintance's son ("Jimmy") was involved in a 3-way love triangle (mistake 1). While she was at the house, she stole jewelry from the mother, enough to make it a felony. The girl's other boyfriend ("Bobby") returned most of it, but it is on report, and the most valuable items are still in police custody.

After this, Bobby had the girl drive Jimmy to meet Bobby to get her cell phone. While en route, Bobby called and had them go to his place out in the country for this transfer instead of someplace more public (second big mistake). When they arrived at Bobby's place, he had them go to the end of the lane. When Jimmy got out of the car, Bobby shot him with an AK-style rifle at about 30 ft. Jimmy was unarmed, although when the police showed up the girl gave them a pocket knife and said that Jimmy had it in his hand. We believe it was a setup, as threats had been given prior to this.

Ribs broken on entry and exit, lung collapsed, narrowly missed his heart. He has been in and out of the hospital since then, no money, no insurance, his mother has little money. It has been quite an ordeal, this kid has been fighting for his life.

The shooter is still out loose, no investigation is going on, and there does not appear to be any movement towards an investigation. When the mother called the county DA, the DA acted like there was little chance anything would be pursued. When she asked how it could be considered self-defense (what Bobby claims was the case, to explain why he shot him) when Bobby had a rifle, Jimmy was unarmed, and he was 30 ft away when he was shot. The DA simply said that in that county they have their own rules.

This is in a rural county, and the shooter's family owns much of the county and is politically very powerful in that county.

The girl was the only other witness, and her statement to the police was wishy washy. The girl is very afraid of Bobby, the shooter.

How can this be called self defense, at 30 ft, the guy was armed with a rifle, and the victim, even if he really did have the pocketknife, only had a small pocket knife?

Where else might the mother turn to get this investigated if the county DA is not interested? It looks like the DA is bought and paid for by the ruling powers in the county.

The mother is worn out, completely overwhelmed, and has no money. She does not know where to turn. I'd like to help if possible, if nothing else to point out some possible directions.
 
Links to news articles...etc? If you really think there is a conspiracy within the local law enforcement community to bury this the best thing the story can have is exposure. I'd be interested in reading more about it.
 
I don't normally have much use for personal-injury attorneys, but there may be some that will talk to her and/or the victim to discuss a civil judgment. This would prompt a civil investigation and the attorney, if he/she feels strongly enough about the solidity of the case, would likely waive all fees and costs until a judgment or settlement is obtained. In addition, a civil suit may bring about some publicity that might push the criminal investigation along some.
Of course, this advice is based only on what I read here, which is, admittedly, only part of the story.
 
Perhaps call the FBI is all I can think of.
It seems an investigation needs to come from further up.
That, and/or the State Police.

This sounds like a felony, the way he had them drive to a certain place to ambush them!
In thinking more about this, I believe this guy performed a felony. He injured someone in the middle of a literal ambush. You can't tell someone to meet you at such and such a place then open fire on them.

This was premeditated and the guy literally tried to KILL the other guy. It is only by the grace of God that this kid was not killed.

If this guy gets away with this, the next person may not be so fortunate!

Start with the State Police, if they won't investigate, call the FBI.
The local police should have totally investigated BEFORE everything became "hearsay." Now the only thing to go on is their word, and who knows how honest they are and aren't.

So, that is the way the law is in that particular county? Kind of a 'strange' law to me! If that happened here, the state police would be swarming like hornets around honey.

If I were the mother, I would make sure her son stays completely away from these people. They may even consider packing their bags and moving to another undisclosed location. If the guy got away with this once, who's to say he won't try a second or third time at which times, the poor kid may not survive.

But then, like another mentioned, there are really two sides to every story. I'm sure the one boy that got shot isn't perfect as no one is perfect. Is there anything you are not telling us?

This has not seen the light of day in the press, which is something being considered as a way to put pressure on law enforcement to act. The hospital is in another county, and the police reports have not been picked up by any major papers or TV stations. Publicity would come from the press in the other county, which is much more populated with a metropolitan area.

The shooter has made threats to the mother, so she is very uncertain about next steps without seriously compromising her own safety.

And no, this is not the whole story, as you have guessed. Some intervening events and details have been left out.

Unfortunately, this seems to be the way of the world when it comes to the legal system. And though it's nothing new, it's becoming less hush-hush these days and just accepted as the way it goes.

Clients pay Lawyers who pay or make deals with prosecutors, DA's and/or judges and the bottom tier detectives and street cops come to realize that it's a COMPLETE waste of THEIR time if the DA isn't even interested or has it in their best interest NOT to pursue it.

Having said that, it's definitely not a lost cause and it's a good idea to consult as many people involved in the system in that county and inform them of what's going on and plead the case and stick to your guns.

Contact police officers, lawyers, anyone who may be able to shed some light on any valid options. Write letters to senators, congress people, etc. If none of these things make a difference, well....write more letters and keep writing and calling people 'til someone sees you're not gonna go away just because they're ignoring you.

Might not be a bad idea to contact a NEWS station. They're usually drooling for a scandal of any kind. And in your case they wouldn't even have to BS any of the details. Yet, they probably couldn't resist a little sensationalism somewhere in their account.

I mean absolutely no offense to anyone working in law enforcement, though I do truly hate lawyers (Prosecutors particularly), but most of both will admit it's just the way it goes.

Money talks. -And as we're all coming to see it also assaults, kills, robs, steals, and manipulates justice.....as well as everything else on this rock. :)

This is one of the reasons involving the press has been considered, it would make for a nice scandal. The shooter's family is prominent, and not just in the county (details I did not include above). But the mother's safety would definitely be compromised.

No link to give at this point. And as for 21 ft, it was 30 ft, and the guy was not moving towards the shooter.
 
A hungry, ambitious reporter needs to pick this up as a crusade to provide impetus to an investigation through a series of human interest articles. Contact the nearest metro area newspaper(s)/TV news stations and provide them with enough information and facts to garner interest. Good luck to the victim and his mother.

I'm confused. Did she talk to the DA in the county where the shooting occured, or did she talk to the DA in her county who said the quoted sentence?

I'd get something in writing from the DA of the county where the shooting took place. If he opines it was just a lover's spat, self defense sort of deal then turnabout would be fair play I suppose. The whole goose and gander thing....

Solely based on a mother's side of the story, I doubt seriously this story even remotely resembles the actual facts of the occurence. There are ALWAYS two sides to a story.
 
Denalipark, I prefer not to give more details regarding location. For my purposes here it is not necessary to know.

nitetrane, I know enough of the events, including much that has not been divulged here, to believe the mother's story. The kid certainly made his mistakes and poor choices, but in the end he was the victim of a premeditated shooting.

And it was the DA of the county where the shooting occurred, and the shooter lives, that said that.
 
I would tell her to speak to an attorney. Chumango, I hope you realize that someone's mother is the last person you will get an accurate account of a story from. Mothers can be very...forgiving.
