GRAND FORKS: Police arrest man near Schroeder Middle School

School rolled into orderly, calm lock-down mode

Heavily-armed Grand Forks police arrested David Luke Davis, 49, Wednesday afternoon after getting a tip that a man would be at Elroy Schroeder Middle School with a weapon around dismissal time.
The arrest took place less than a block from the school.

Davis is apparently the parent of a Schroeder student and has contacted the school in the past, which is how police were able to get his name and identify his car, even though the tip they got did not include that information.

Capt. Mike Kirby said officers have interviewed the suspect but cannot yet say anything about motivation.

Schroeder was in lock-down mode shortly before the arrest when administrators got word from police.

According to the procedure, administrators used a code word to alert teachers who gathered students in classrooms, locked doors, closed shades and turned the lights off. A gunman should have no clue which classroom was occupied.

Because of the early alert, police were already outside watching the entrances to the school.

Assistant superintendent Ron Gruwell said Davis never got close to the school, so students and staff were not in danger.

Davis, a tall, longhaired Caucasian, is charged with terrorizing, a class C felony; carrying a concealed weapon, a class A misdemeanor; and disorderly conduct, a class B misdemeanor. He has no known Grand Forks address.

The action took place near the intersection of 32nd Avenue South and South 10th Street. A lone officer waited by the house at that corner while his colleagues were nearby watching entrances to the school.

At around 1:45 p.m., Davis drove by in a blue-green four-door Mercury Tracer, Texas license plate X33-CKN. The waiting officer waved him down, at which point all the other patrol cars swarmed in for the arrest.

Arresting officers made an overwhelming show of force with six squad cars and four civilian cars. Several were armed with SWAT team-type weapons and a K-9 unit was on standby. Davis did not resist arrest.

In the back seat of the car, officers found an unloaded shotgun.


Quiet ruled school

The scene inside the school was relatively calm.

Math teacher Julie Holien said the lock-down was orderly in her classroom. The students, she said, "They were very good, very quiet. And they were scared, but not too scared."

Thoughts of the shooting at Red Lake High School in Minn., earlier this week, where 10 died, passed through Holien's mind and her students' as well. They thought it was odd that Schroeder seemed to face the same situation so soon after, Holien said.

Schroeder has an armed community resource officer assigned to the school.

Lock down procedures here were instituted shortly after shootings at Columbine High School in Littleton, Colo., in 1999, she said, and there's been at least one drill.

My mother taught at the Elementary school right across the street. That school was not warned I hear and there are some upset parents.
I think there is more to this story than is being told.
Could it be he may have just had a shotgun in his car? That's common in ND.
I know he was arrested but this story doesn't say if the guy actually went to shoot up the place.
He did have a child in the school.

I have questions. :confused: :confused:
 
There are several unanswered questions:

I'm wondering what the intention of the tipster was. Someone who had a personal beef with Mr. Davis or a legitimate concerned citizen believing that Mr. Davis was about to do something illegal? If so, how did this tipster know?

That would explain why he is near the campus. Possibly to pick up his child.

Does he have a motive? This implies he was motivated to do something....like do something illegal.

Report said Mr. Davis was less than a block before being stopped and arrested. Does anyone know the law in that state re: how far you have to be away from a school if you have a weapon?

After the Minnesota school shooting, however, I do not question the officer's display of force:

interesting...we'll see how this case unfolds. If this goes to trial it may be difficult to get an impartial jury after the MN school shooting.

And yes, your questions should be answered, preferably by someone not trying for "The Sensational Story of the Month Award".
 
These one leaves me scratching my head. Parent of someone at the school just doesn't jive well with school shooting. Perhaps he didn't have custody of the child and was going to kidnap him? Hmmmmm.

Too many unanswered questions, too much room to speculate.

The story MUST be leaving out a LOT of details if they're charging him with all this. (If this were Texas, he'd have broken no law, based on the story alone.) There's got to be more to it than just having an unloaded shotgun in the back seat - from my reading of the story, he could be anything from some poor innocent schmuck who was in the wrong place at the wrong time to some crazy psycho nut job.

Can't form a worthwhile opinion based on the allegations and innuendos in the story. We'll see if there's a follow up.
 
Yeah, as soon as I started reading, I thought "Ex-Wife...".

Probably the guy had his shotgun in his car for some innocent purpose like hunting, taking it to the shop, etc... I have a buddy who had his shotgun in the car, unloaded and cased, for several weeks this fall. Took it to work, to the mall, and so forth. It didn't leave his car unless he was out in the field, but it was in there.

It just strikes me as odd that for a man contemplating shooting up a school, this guy had only and unloaded shotgun in his car. And was he really terrorizing the school? It seemed like he was probably going to pick up his kid. Iguess the authorities have to play it safe, but I am really hoping that the guy is completely innocent, and that the mystery informant gets some hard time of his or HER own.

Terrorizing, concealed weapon complaints carry five-year, one-year maximum penalties

David Luke Davis, the man arrested Wednesday with a shotgun near Schroeder Middle School, faced criminal complaints for terrorizing and carrying a concealed weapon at his first court appearance Thursday.

Magistrate Harlan Dyrud set bail for the 49-year-old at $50,000 for the first complaint and $1,000 for the second.

A tipster had told police Wednesday that a man would be at Schroeder with a gun when school let out. Working with school officials, they'd identified him as Davis, the father of a student there.

In the past, he has complained to the school board that he was not receiving his children's school records. He also asked schools not to release "directory information" about his children.

When heavily armed officers arrested him Wednesday, they found a shotgun in the back seat of his green Mercury Tracer. There was no round in the chamber but several in the magazine.

The complaints made Thursday did not contain much new information.

Assistant state's attorney David Jones said more facts and evidence would be forthcoming at the preliminary hearing scheduled for 3 p.m. April 20.

In the terrorizing complaint, the state said Davis had threatened to appear at Schroeder with a shotgun, thereby causing fear and disruption at the school. But Jones would not elaborate how that threat was communicated.

It apparently was not made to the school because administrators would have alerted police rather than the tipster.

In the other complaint, the state said Davis was "carrying a firearm concealed in a motor vehicle when not licensed or privileged to do so." The specific crime here was that his shotgun was hidden in a T-shirt behind the driver's seat.

Terrorizing is a Class C felony that carries a maximum sentence of five years in prison and/or $5,000 in fines. Carrying a concealed weapon is a Class A misdemeanor with a maximum sentence of one year and/or $2,000 in fines.
 
Lets face it - this guy was hothead, and had caused lots of trouble withthe school before: "In the past, he has complained to the school board that he was not receiving his children's school records. He also asked schools not to release "directory information" about his children."

And then he drives around with an empty chamber - what a dofus!

Obviously complaining that a school has failed to send records, possibly report cards to him, or requesting that his information not be in a school directory are a sign that someone is an unstable and dangerous individual.

What is next, imprisoning people who ask to be put on no-solicitation / no-call lists. Surely they are all terrorists.
