Any Knife laws in CA? Is OC spray legal there?

Hey all, me and the Fiance are going down to Southern California to see family as well as go to a Pre-Hospital Trauma Life Support course necessary for her degree.

I'm not bringing any guns with me, but I'm planning on keeping a knife on my person.

I'll be taking a Spyderco Endura on my person(4 inch blade, full serrated) and a Delica ( 3 inch blade, plain edge) in a backpack.

From what I've read Knife carry is legal so long as a knife is folded. Can't be a switch blade or an auto. Please correct me if I'm wrong.


Also, Is OC spray legal in CA? From what I've read is that you can carry it if the net weight of OC is under 2.5oz, and you don't have a felony.

You've got it generally correct, both halves.

Knife law is a bit more complicated than you note - special treatment for schools, and different for each of grade schools, Cal State, and Univ of CA; and local laws can be different from the state law. See also http://www.calguns.net/calgunforum/showpost.php?p=2289918&postcount=6

The other thing for OC is that the dispenser must be properly labeled. It's Penal Code 22810.
 
In the State of CA, you can carry as large a folding knife as you'd like as long as it is concealed. Just don't carry a fixed blade concealed or a switch blade or auto at all. However...

Depending on where you'll be in Southern CA, local ordinances might limit you to a folder with a 3" blade
 
Another question:


When they say net weight they mean the actual amount of OC right? Or do they mean the whole thing? (Which I believe would be gross weight... right?)
 
They sell pepper spray in every sporting good store in CA and Ive seen in it other stores as well. Ive even seen it in CVS or Walgreens before.

Which way are you coming in.... What city are you going to.... Where is the class held?
 
I'm coming through Nevada. I'll be stopping in Santa Ana for a day or two, will visit Huntington and Long Beach (Where I grew up) and will go to Santa Cruz for the course.
 
Ohh... if you grew up in Long Beach then you know the area at somewhat.

Just go to any Big 5 or Turners (theres lots of Big 5s everywhere).

If you come in down the 15 there is a Bass Pro in FootHill (Ontario area) in a huge shopping area called Victoria Gardens.

Santa Ana has both good and bad areas but the bad isn't THAT bad. Huntington and Santa Cruz are fine. Long Beach... mostly bad IMO. The gangs there are waaaay worse than any homies in Santa Ana. And despite what some people say, LEO don't just pull you over for no reason and if you get stopped, Ive never heard of any of my friends/relatives get asked about guns in the car. I was born as raised in OC and lived there for about 37 yrs.
 
Are tasters legal in CA. I have a niece moving there for awhile. She is going to be SHOCKED when I tell her no concealed carry for her in CA. Can she own a shotgun in CA. Can she bring her own to CA?

Yes as long as she doesn't have a felony or Domestic Violence conviction.

Yes ... and at least until Jan 1 2014 she wouldn't have to 'register' it as currently has to be done when bringing a hand gun into CA. Currently a hand gun requires a form and a fee of $30 or something like that and I think when 2014 comes it will be the same for long guns.

She would have to make sure that the shot gun doesn't have the banned evil features. A run of the mil 18+" barrel pump shot gun with a regular stock is A-OK and doesn't have to be 'registered'.


As far as tasers go... do you mean the ones that shoot the wired probes or the ones you hold and touch some one with?
 
Can't say if the taser that uses cartridges are legal or not, but I see the standard bad breath distance ones being sold here all the time. Also for the time being (laws are constantly changing) any pump action shotgun is fine as long as it does not fall under destructive device, a semiauto shotgun must be treated like a rifle to determine if it is an "assault weapon". You should go over to the calguns forum, lots of good info and stickies with charts over there. If she is willing to bear the heat of the southern san joaquin valley summers all the local county sheriffs will hand her a CCW just for going to the class and submitting her paperwork with payment (as long as she checks out on the background check of course).

That ordinance exists in West Hollywood. I think a few other municipalities have the same "3 inch" ordinance.

Crazy, of course, but ...... it's California.

As used in this part, “stun gun” means any item, except a less lethal weapon, used or intended to be used as either an offensive or defensive weapon that is capable of temporarily immobilizing a person by the infliction of an electrical charge.
Penal Code 22610.
Notwithstanding any other provision of law, any person may purchase, possess, or use a stun gun, subject to the following requirements:

(a) No person convicted of a felony or any crime involving an assault under the laws of the United States, the State of California, or any other state, government, or country, or convicted of misuse of a stun gun under Section 244.5, shall purchase, possess, or use any stun gun.

(b) No person addicted to any narcotic drug shall purchase, possess, or use a stun gun.

(c) (1) No person shall sell or furnish any stun gun to a minor unless the minor is at least 16 years of age and has the written consent of the minor’s parent or legal guardian.

(2) Violation of this subdivision shall be a public offense punishable by a fifty-dollar ($50) fine for the first offense. Any subsequent violation of this subdivision is a misdemeanor.

(d) No minor shall possess any stun gun unless the minor is at least 16 years of age and has the written consent of the minor’s parent or legal guardian.
 
There are several parts of L.A. that have the 3" limitation, as well as San Francisco. However, outside those areas, there is no limit on blade length for folders.

Surprisingly, there are also no restrictions to carrying a tomahawk for personal protection
 
Be very careful not to carry any knife with blade sharpened on both sides. Big no no.

Pepper spray was legal here in Cali a few years back when I bought large canisters of the super potent 10% strength the cops use.... I bought it at the local police uniform shop.

For some reason, this is a common mis-belief. Nothing in CA law makes double-edged knives illegal; they are available for sale in CA stores.

It is, however, illegal to carry a fixed-blade knife - any length, single or double edged, sharpened false-edge, whatever - concealed.
