Well unless you are in your property you are in violation of the law.

Our governor declare a STATEWIDE state of emergency because the hurricane may swipe the coast. When she did so she took everyone's second amendment rights away.

So if you missed the declaration (as I did) and got to work carrying concealed, you are now in violation of the law. Hope you have a good day and remember this in November everyone.
 
Don't panic.
And don't be an alarmist.

Simply declaring a statewide "state of emergency" is not the same as declaring Martial Law and it does not necessarily negate your right to carry.
 
Per NC General Statutes, when a state of emergency is declared:

Pursuant to N.C. Gen. Stat. § 14-288.7, it
is a Class 1 misdemeanor "for any person to transport or possess off his
own premises any dangerous weapon or substance."

There is no exception for recreational shooting.
There is no exception for hunting.
There is no exception for having a concealed carry permit.
The prohibition applies to all possession -- open carry, concealed carry,
transportation in a vehicle.

So yes, it is time to panic. This IS a matter of law and a current lawsuit against the state (headed by Alan Gura) from something similar in the Winter in the city of King.

If you are carrying a weapons off your property in NC today you ARE guilty of a crime. If you go hunting this weekend (dove season opens) you are guilty of a crime.

Wow. Thanks for the heads up. That's a horrible statute. I've never heard of it being enforced. Looks like they would announce some sort of hunting ban for the duration as I've gone hunting (and chatted up the local game warden) while we were under a state of emergency due to storm damage in the past. I never knew. Obviously the leo who I was hunting with nor the game warden didn't know, either. Long time ago, though...

I missed the declaration this morning, also. I have no further comment on this matter....
 
That's just stupid.

How much enforcement could there possibly be? It is so monumentally anti-freedom and anti-sense that it weakens all other laws by inclusion.
 
This is being fought in court and I am confident that eventually it will be dealt with through the supreme court. However until then...we have to put up with BS rules like this.

I agree, ANY LEO or Ag who cracked down on folks would find themselves on national news quick, but that the law is even on the books is offensive.
 
Thats BS. Ironically I just read that law the other day in my BLET class. I thought nothing of it at the time.

What makes this suck even more is I was supposed to go shooting this weekend after a big test. :cuss:
 
That is silly. I hope that law is soon abolished, and will find out if my state has that law. I doubt there will be a massive crackdown on CCP holders, but I would postpone trips to the range just in case. Maybe you should call your DA and find out for sure if they will enforce that statute on hunters, etc.
 
Well I called a friend to tell him he might not want to go to the range today...and he was already there...

Apparantly that association doesn't know this law either.

That law bites in a major way. You won't risk going because you're jeopardizing your future career (I assume since you mentioned BLET). That's unfortunate and understandable.

But I'm willing to bet there will be 100's of people dove hunting this weekend without issue even if the state of emergency is still in effect. I fully support those folks doing that without punishment...but it will be a shame that some may be in violation of the law.

My girlfriend wants to go shooting this weekend. My range is on my property. My two properties are separated by another person's land. I guess I can't (legally) go do that Saturday. :cuss:

Whenever our “safety” is in question, this law tells me that the first thing our government wants is to strip private citizens of their firearms (and right to protect our families…or go dove hunting) when not on our own property. Complete BS. :fire:
 
In a state of emergency they seek control. Guns threaten this in their eyes. Sometimes it seems like they think everyone's going to go hog wild and burn down the town just because of a storm. Allowing you to keep tools with you so that you can insure the safety of your family likely doesn't cross their mind.
 
If people did start to freak out during a "catastropy" and begin to riot, I would want the people were actually law-abiding enough to get a ccw permit in the first place to be armed to serve as a buffer in cases of civil disturbance.

The only time a citizen should be stripped of their license to carry is if their actions warrants it (IE, being irresponsible, disorderly, etc). If I (or my family in my presences) were ever assaulted during a time where I'm disarmed due to such a BS law, I would do all I could to raise a public stink and probably sue even if I know it's a losing battle, just for the principle of it.

Other countries' dictatorships have declared a state of emergency just to prevent them from being overthrown.

I'm not saying that's the case here, far from it.

I'm just saying having this law on the books makes me very uncomfortable.
 
Those who have been posting on other boards about Katrina will be watching close...

NRA's actions against NO gun grab will be thought about a lot, prior to any problems and taking guns away from citizens I would have to think...

Be watching Dave Workmans writings to see what he thinks, pretty much an alarmist and LEO basher I have noticed:(

I wonder how many states have laws like this on the books.

I believe NC is the only one which is why the SAF targeted them with a lawsuit.

This nonsense brought to you by the state that requires a pistol purchase permit for a cross bow!
 
A hurricane on the Outer Banks affecting gun rights in the Smoky Mountains..? That sounds like a law that would not stand up in today's Supreme Court. Some Tarheel may get famous as a test case.
 
Well I was in a basic check point today . Told the sheriffs officer that i had a ccw and he asked where my hangun was, i told him , he look'd in to see and just said not to grab it as i was ok. Checked my papers and on my way. Did not even think about any problems.

1. Possible hurricane (current)
2. Snowstorm (last year)
3. Drought (2 years ago?)

Before long, they'll have more 'state emergencies' than Carter has little liver pills!

Let's hope the SAF suit clears up this little problem?
