Deputy's gun reportedly discharges at IHOP

For the time being, officials with the Saline County Sheriff’s Department are not discussing an incident Monday which a deputy’s firearm apparently discharged accidentally at the International House of Pancakes (IHOP) restaurant in Benton.

A local businessman who arrived at the restaurant after the incident said he was told about the gunshot by a restaurant employee.

According to that account, a deputy who had been at the restaurant for lunch accidentally discharged his weapon while he was in the men’s restroom.
The shot reportedly went through the restroom ceiling, where there is a bullet hole.

Several people inside the restaurant apparently heard the shot.
According to the businessman, who asked to remain anonymous, the restaurant employee asked the deputy what the noise was and the deputy allegedly replied, “The toilet seat fell, making the noise.”

“And with that, (the deputy) proceeded to walk out of the restaurant,” the businessman said. “He lied to the waitress on his way out the door, according to her.”

A member of management with IHOP reportedly followed the deputy into the parking lot. The IHOP representative “confronted (the deputy) on the parking lot and then he ’fessed up to it,” the employee said.

Employees of a local plumbing and construction company were called to inspect the area to see if the shot had penetrated the roof, the businessman told the Courier.

The deputy involved in the incident is described as a “heavy-set guy” and is believed to be an employee in the warrants division, but this has not been confirmed.

According to an employee in the county human resources office, deputies are required to fill out a report any time they discharge their weapons, whether accidentally or on purpose, unless it is done on the firing range.

The incident was discussed briefly Monday night in a meeting of the Saline County Quorum Court Finance Committee.

In that setting, Justice of the Peace Doug Curtis, who chairs the committee, asked sheriff’s Capt. Jason Massey how much damage the county would be responsible for because of the incident. Massey said the incident was being investigated and that he would not comment on it.

After the meeting, Massey said no one was hurt in the incident. He declined to say whether the employee is still on active duty or how long he expects the investigation to take.

A Courier reporter, attempting to interview employees at the restaurant Monday afternoon, was asked to leave by management.

Today, Massey again declined to identify the deputy involved or to discuss additional details about the incident, which he said is being investigated internally.

He also said he would not be releasing the deputy’s name Sheriff Phil Mask return this weekend.

Massey was asked whether a report is required any time a deputy’s weapon is discharged. His response was that “whatever report would be made is an internal report that goes toward the investigation.”

“All of this goes through a process,” he added. “That’s what this is going to go through.”

Massey said that “everything that is under our policy procedure is abided by when we open an investigation. Once it gets through that, we’ll let it go.”

I can see if it shot through the floor, but the ceiling?! How did he manage that?:rolleyes:
 
If you visit the Saline County Sheriff's website (http://www.salinecounty.org/sheriff_bio.htm) you will see that the firearm in question is indeed a Glock .40 .

Not one of us is perfect, and all of us are prone to occasionally being inattentive and careless on occasion, and for certain, we all make mistakes.......but that Glock trigger makes it too damn easy to make a mistake of the most serious kind, IMHO.

I would have to speculate that he was trying to conceal his firearm from view under the stall door while his britches were down by his ankles, and he bumped the trigger with his thumb, finger or part of his clothing.
 
Aw geez. I know (or at least knew... it's been awhile) a bunch of the LEOs in that area. Hell, when I worked for an armored car outfit, a bunch of guys got hired out of our ranks, and that had a lot to do with our home purchase well away from that area.

One had worked for a larger dept. once, was fired for a wrongful shooting, but never charged criminally. He bragged about the shooting to us at work, but of course never to anyone in any sort of 'official' capacity.

Another worked as a part time ossifer before being hired full time. He bragged constantly about using his data terminal to collect contact info on attractive female drivers. He also bragged about pulling folks over based on skin color, stating frequently that he'd love to chase anything less than lily-white out of the country entirely.

Yet another is a short, stubby, arrogant bastard who seeks confrontations, relying on his badge and gun to keep him 'on top'.

I'm sure there are a few good guys in uniform down there, but as with anything else, the bad apples are the smelliest, and most noticeable.

Hey now ..... Take it easy on ol' Bloody Dreadlocks. He's still upset that gun made a foo' of him in front of all those kids. But what's this deputy's problem? He must've been "fat fingering" all over his shirt, belt, pants attempting to zip up when "BANG!", so he exited the back of the establishment with his zipper down, shirt half hanging out, and a trail of TP 50 feet behind him.

Not once in my many,many,many years of carrying a Glock{or any other handgun} have I had a ND, let alone one go through the ceiling while I was sitting on the toilet.:scrutiny:

This is someone who obviously cannot handle doing more than one thing at a time and should look for another line of work.


Do you really want a LEO on the job who sits on the toilet and plays with his gun in public.

Do departments provide any training on safe handling of weapons while answering a call of nature?
 
Geez, I don't know if they do or not, but my CHL class certainly didn't provide any and in 7 years, I haven't had a bathroom ND. Of course, I don't put my finger on the trigger in such situations either.

They probably don't get toilet training, shower, car, on instructions for what to do during intimate moments with their loved ones, but then again, why should they? The same basic 4 safety rules apply regardless.

He should be released from the force immediately...the bullet hole was in the roof meaning he had hes gun out and hes finger on the trigger
 
I make sure to always take care of the "big job" before venturing out of the house armed. I know it will probably happen eventually, but I'm not excited about having to use a stall and trying to figure out what to do with my piece.
 
That report should be interesting to read.

BTW, these threads involving police NDs need to be collected and put in the THR library. When the antis start bleating about how highly trained the police are and only they have they training to carry weapons safely, we can pull out the library of police NDs.:)
