Are Chinese SKS C&R now?

    I know that one of the C&R rules from the ATF is a gun that is over 50 years old can be classified as a C&R rifle.

    Now, I've remember seeing rifles that were not 50 years old being classified as C&R because the patten the rifle was based on was 50 years old, like the Romanian SKS.

    So here is the question: The Chinese pattern (SKS 56) is now 51+ years old. If you can put a Chinese SKS back to the original configuration including the spike bayonet, can you claim C&R status with it?

    any firearm 50+ years old is automatically classified C&R. the firearm itself, not the pattern.

    the thing is the ATF says they have to be in original configuration.

    often the importers have to get a letter ruling on just what does and does not qualify.

    you could just as easily get such a ruling by merely requesting it. my guess is they might well rule it as a C&R if it is unique in some way, regardless of it being 50 YO or original configuration.

    i wouldn't assume, that anything with the BATFE is "automatically" ok by anything us regular joes would call common sense (remember, the BATFE has proved lacking in that)

    they publish a book, and yearly updates that list specific guns, serial # ranges, and more to decide if its CR eligible.

    Yugo sks's are c&r and they are less than 50 years old. They were declared c&r, chinese rifle haven't been and they aren't 50 years old. Mark
