As before stated, it's a state by state thing.
As an aside though, I prefer the Monadnock version to the ASP version as you don't have to beat it into the ground or other nearby objects to close it as you do with the ASP. With the Monadnock, you simply depress the button on the end and slide it shut-- roller-cams hold it open instead of friction.
