Attn Georgia members whose CCW has taken longer than 60 days to be issued

Wife has been waiting since January for permit from Fulton. I was thinking about posting on this the other day! It took them a little over two months to process mine (renewal from another county). Wish they would hurry up!
 
I understand that Gwinnett, Fulton, and some of the other metro-Atlanta counties are taking many months longer than the allowable 60 days. The law is clear about the responsiblity of the Probate Judge to issue the license "no LATER" than 60 days from the date of the application, barring any negative information from the reporting authority.
 
Approaching 90 days waiting for my CCW from Clarke county. They told me it would take 90 days.

What law should I print out and take in to make a "the law says 60 days - what's going on here in this 'law enforcement' department?" point?
 
A few years back, my Cobb County one took 128 days. I was told it was due to the Federal checks taking awhile, but since I was working in a VERY bad part of town, this wasn't too reassuring.

I sent an email, as I'd like to see the Government follow its own laws for a change.

(Disclaimer: I have dual-citizenship, which appears to delay something in the whole process. It also causes the NICS checks to take the full 3 days for me. I'd also like Georgia permits to allow exemption from that again as well.)

Oddly enough, a friend in Cherokee had his in 3 weeks.
 
I understand what some of you are going through, I applied for my CCW in april and I called and the clerk at the fulton county probate court told me that it would take 1-8months to process everything.

I am currently waiting for my GA CCW permit, and the wait is rapidly approaching 90 days. For assorted reasons (such as driving over 4 hours each day, especially when certain groups attempt to shut down the city (Atlanta) as has happened several times during this wait) I am concerned about being disarmed without specific cause, contrary to state law. Upon submitting my application, I was told the wait would be 90 days.

Kindly keep me informed of NRA activities on the GA CCW 60-day issue, and I would be delighted to help in any way possible.

Every day I come really close to cutting mine into a couple of pieces and mailing it back to the probate court with a brief note explaining that I no longer agree to playing the game of asking/receiving their permission to exercise my fundamental right to arms.

I'm too chicken.

I won't be getting it renewed though.
 
16-11-129 (d), OCGA: "(d) Investigation of applicant; issuance of license. Each law enforcement agency, upon receiving such applications and obtaining such fingerprints, shall promptly conduct a thorough search of its records and records to which it has access and shall notify the judge of the probate court within 50 days, by telephone and in writing, of any findings relating to the applicant which may bear on his eligibility for a license under the terms of this Code section. When no derogatory information is found on the applicant bearing on his eligibility to obtain a license, a report shall not be required. The law enforcement agency shall return the application and the blank license form with the fingerprint thereon directly to the judge of the probate court within such time period. Not later than 60 days after the date of the application the judge of the probate court shall issue the applicant a license to carry any pistol or revolver if no facts establishing ineligibility have been reported and if the judge determines the applicant has met all the qualifications, is of good moral character, and has complied with all the requirements contained in this Code section."
 
I applied for mine last monday. The judge told me that the current wait was 3-4 months. She said the delay was because the GBI was really slow. My brother's boss got his this monday (yesterday) and he was over the 100 day mark.
 
When one enquires about the status of one's license, one is either given the GBI/FBI delay excuse or reference to an old State Attorney General Opinion, opinion U-78-45.

The AG opinion was written in 1978 when the law was much different than it is now. That, and an AG opinion does not relieve anyone from their obligation to obey the law.
 
I don't think the GBI slowness is the problem.

If it were, then the entire state would be affected, not just metropolitan counties around Atlanta.

I am in south Georgia, and my initial license took less than 6 weeks, and my renewal took less than 14 days.

The metro Atlanta counties are where this problem is, in my opinion. It is not coincidental that these were the same counties were the opposition to the Stand your Ground law was also found.
 
The GA Code is pretty clear: The reporting agency has 50 days to complete the report; if there's no negative info, then the reporting agency's not required to submit a report at all. Accordingly, the Judge of the Probate Court, having received no negative information (or no report), MUST issue the permit within 60 days of the application date.

There's an AG opinion that's more recent than the '78 opinion that states strongly that "shall issue" means "SHALL ISSUE!"

Oh, BTW, since there are no punitive provisions, regarding the obligations of the Judge of the Probate Court, the applicant's remedy would be to seek a Writ of Mandamus from the proper court of jurisdiction. Good luck on that! :)

I can't find anything on the GA AG's site.
 
I got mine the day I applied...took about two hours. I guess that's one of the perks of living in a small county??

I applied for a permit in Georgia the day before my retirement from the PD on 8-20-1995. I did still have a badge and ID card...and it was a doggoned good thing, since I was still waiting 3 years later. I moved to New England in 1999 and applied for a permit here. I had it within 2 weeks. Same with the renewal.
Now my youngest, who is an active duty Marine, is trying to get a permit with roughly the same results. LAME excuses all the way to NO excuses.

And like Curly Howard, "I ain't no dummy...that's a real rock!!". I figure a lot of the foot dragging is just to see if, "you anger easily...or talk ugly to the judge...".
 
I recently renewed my GA CCW license, for the third time.

It only took a week or so to get the license in the mail, down here in Laurens County (Dublin). The local office seems to take great pride in being responsive to the needs of our responsible gun owners.

I pity you folks up around Atlanta.
