Well, it has some tiny weirdness, but it removes the penalties from civilians carry concealed without a permit, but still requires a permit to carry on school grounds...no, I didn't stutter, CCW permit holders would be allowed toc carry on school grounds, dropping off or picking up, and to "respond to emergencies."
Lest ye think this is a bill by one lone voice in the wilderness, it has 22 cosponsors, inclduing the Senate Majority Leader and the Senate President Pro tem.

Federal law doesn't allow unlicensed carry on school grounds. School carry is only legal if licensed and there are no state laws banning it. Also, keeping an optional permit would continue to allow carry in some states that only recognize permits from the licensee's home state. Sounds like a great bill.
 
Ok, went over it word for word, and compared it with the current law. As I read it, carrying concealed without a permit would become a crime only if you were carrying it while committing, or attempting to commit a serious offense.

The schools clause is a little weird. The way it's written, it does seem to say you can bring your concealed weapon on school grounds to drop off or pick up your kids only if you have a CCW permit.

We'll have to see what happens, and I'd love to get Alan Korwin's take on this.
 
We still need to amend the Restaurant prohibition. Cannot carry while out to lunch or dinner unless eating at fast food.:mad:
 
What restaurant prohibition? To the best of my knowledge, and I just read Title 13, chapter 31, there is no law in Arizona prohibiting you from bringing your gun into a restaurant, unless that restaurant is posted by the owner.

I wish that little half inch border we share with AZ would somehow rub off a little of this onto us. Unfortunately, the Californians moving into Colorado are rubbing off much quicker.:cuss::banghead::banghead::fire:
 
That's federal law.

What's Federal Law? School Carry requiring CCW? Then yes.

If you are referring to carrying in a restaurant that serves alcohol, then no. No Federal Law concerning restaurant carry and alcohol.
 
Link, please? I have never heard of that, due to the fact other states are fighting thier state provisions barring it, and no one ever mentioned a fed law.
I agree, keeping a CCW permit keeps us in line with Alaska, too, who has permitless carry, but keeps a permit available for those who wish to travel outside Alaska and take advantage of recprocity.
Nifty stuff, and we are working on the resteraunt posting law too, that bill has been filed, as well as justification for defensive display of a firearm. Napalitano the veto monster is bye bye, so I am hoping Gov Brewer will be more amenable.
 
You're right. It's one of those laws not listed with the gun laws. It's buried elsewhere.
So cite it. Here's a link to the US Code online.

It may take you awhile to find it though, as such a federal law doesn't exist. There's plenty of states where carry in restaurants that serve alcohol is legal. There's even some where carrying in bars is legal.

As far as I know, the only place that's not federal property where federal law bans possession of a firearm is primary/secondary schools, in 18 USC 922(q). Even then there's plenty of exceptions to that law.

That's how WA state is and it makes very good sense to NOT have parent's guns sitting in cars in the school parking lot.

As to restaurant carry, the AZ law is technically no carry where alcohol is served. Practically that means no carry at every place I normally eat lunch or dinner.

From the AZ DPS ccw website:

Can I carry a firearm into an establishment that serves alcoholic drinks for consumption on the premises if I have my CCW permit? No. No one (except police officers) may carry a firearm (concealed or not) into any establishment that serves alcoholic drinks for consumption on the premises (this includes restaurants). The only exceptions are: 1) you temporarily enter such an establishment for the purpose of reporting an emergency and do not receive, possess or consume an alcoholic drink; 2) you are the licensee or an employee (acting with the licensee's permission) of such an establishment; 3) you are summoned to assist a peace officer who is acting in the official performance of official duties; 4) to enter hotel or motel guest room accommodations or 5) the exhibition or display of a firearm in conjunction with a meeting, show, class or similar event. Active and retired officers carrying under LEOSA may be prohibited from carrying concealed weapons if the establishment is posted, see the LEOSA page for details. (ARS 4-244.29 - 30, 13-3102.C.1 and Public Law 108-277)

Several efforts have been made to amend this law, but no success so far. I understand a new effort is underway this legislative session.

That law was overturned by the Supreme Court. The feds have no jurisdiction in state schools.
