background check and transfer

I had to send two Taurus guns back for repair.

A PT1911 and a 24/7 OSS 9mm. Both minor repairs, but I thought what the heck, let them fix it.

Well they replaced the 24/7. That's a good thing.

I was going to ship them myself. I was at my gun shop and her offered to do it for me, so that's cool. But they send it back to who sent it to them.

My question -

I will have to do a new background check for the new replacement, and this is fine. My gun shop charges $50 for this.

Should Taurus cover this for me? I don't think I should have to pay another fee on a $450 gun.

Actually, unless your state/local laws don't allow it, taurus can ship them directly to you. When I had to send a revolver back for them to work on, it was fedExed back to my door, legal as church on Sunday. I shipped through UPS overnight.
 
Armoredman is correct, if you ship a gun to a manufacturer for repair, the manufacturer can send it directly back to you.

However, if you get your FFL dealer (i.e. local store) to send the gun back, Taurus HAS to send the gun back to the dealer that sent it to them. Once the dealer gets the gun back, he will be required to transfer it to you again, but should not charge you any sort of fee for doing so, assuming you bought it from him in the first place. Keep in mind that no FFL is required to charge any sort of fee for filling out paperwork--and to charge you a fee on a gun that had to be sent back for warranty work is absolutely unacceptable in my book.


IMO you made the right choice in sending it back through the dealer. Handguns have to be sent overnight and that is expensive, as well as a hassle.
 
I'd try to get him not to charge for the transfer if it was me. If he wouldn't drop the charges, I'd never deal with his shop again, and I'd let everyone online as well in person know which shop it was and what they did.
 
Just my opinion - if he charges $50 you need to find another FFL. Here in Missouri the going rate is $15-$25, and never over that.

$50 for a transfer sounds excessive.

They should not even have to do a background check as it is a warranty replacement of the same model firearm. Even with a different serial number, you fill out a 4473 but no background check and the dealer logs it as warranty swap.
 
Yeah, I didn't say anything about the $50, but it is very high. Here most shops charge $20-25. Several do it for $20 and $2 for the background check fee, a few do it for $25. There is also one that is a Pawn Shop and charges, $10, but he is the only one I know of that cheap. I had a shop tell me they charged $37 to transfer rifles, and I thought that was way too high.
 
Was the gun bought through this dealer and then sent back soon after due to a fault?

If not then any transfer that comes through him is no different from you buying a gun online and you should expect to pay the fee.

If somebody sends a gun in and needs an FFL to handle the transfer, then thats a service you have to pay for (though i would shop for better pricing).

Indeed once the work done is something between you and the manufacturer then really the FFL is out of the equation. If it were me i would help a customer out and handle it for them.
 
$50 is excessive to begin with.

If the same shop you bought the gun from is charging you for warranty work on something they sold you, then I would never go back there again.

My local FFL charges $35 for transfers, which I still believe is too high. I have bought two guns from him that needed to be returned to the factory, and was not charged either time for shipping or any other fee. I like shopping there because I know that if I get a lemon, I can have them send it to the factory for me.

The cheapest i can get my PT1911 shipped to Taurus is $38.
If they did replace the gun id pay the $50 to have a new gun and not be mad.

Mine also may be fully replaced also, And if thats the case it may be best i just send it in myself and save a few bucks. But my local shop only charges $20 for a transfer.
 
Your gun shop is screwing you.

No 4473 is required to regain guns tendered for repair. This is the same law that allows you to ship your guns directly to a licensed gunsmith for repair and allows them to send the repaired gun directly back to you.
 
Tell your gun shop to read 27 CFR (Code of Federal Regulations) 478.124:

§ 478.124 Firearms transaction record.
(a) A licensed importer, licensed manufacturer, or licensed dealer shall not sell or otherwise dispose, temporarily or permanently, of any firearm to any person, other than another licensee, unless the licensee records the transaction on a firearms transaction record, Form 4473: Provided, That a firearms transaction record, Form 4473, shall not be required to record the disposition made of a firearm delivered to a licensee for the sole purpose of repair or customizing when such firearm or a replacement firearm is returned to the person from whom received.

Refuse to pay their fee, refuse to fill out a form 4473, and tell them that if they don't give you your replacement gun back you are going to notify the local ATF field office. If it's too late, and you have already fell prey to their scheme, notify the local ATF field office.

No 4473 is required. In fact, we sent a gun back to Taurus through the dealer we bought it from (Wholesale Sports). The gun was a gift to my wife, so she turned the gun in under her name. We asked if there would be a problem with them giving the gun back to her or giving her a replacement gun because she did not have in-state identification and, thus, could not purchase a handgun from them! They said no problem at all.
