Firearms dealer says he is victim of discrimination

A Carroll County man who helped police break up an unrealized murder plot by purported cultists in 2001 now faces charges, after state investigators said they found 17 unregistered machine guns at his home - including two loaded machine guns found next to a sleeping 12-year-old girl.

State police announced yesterday that Amir H. Tabassi, 55, of the 5400 block of Ridge Road in Mount Airy was arrested on three misdemeanor charges: possession of an unregistered machine gun, allowing an unsupervised minor access to a loaded firearm and carrying a loaded firearm. Additional charges are pending, authorities said.

Tabassi, who was released yesterday afternoon from the Carroll County Detention Center on $25,000 bail, could be sentenced to 10 years in prison, if convicted, for each illegally possessed gun.

"This is a really unusual find for us and a significant violation of Maryland handgun law," Maryland State Police Superintendent Edward T. Norris said at a news conference at the Waterloo barracks. He stood behind a table displaying 17 machine guns and 11 handguns - some of the 87 weapons seized from Tabassi's home.

Norris said that even though Tabassi held valid state and federal firearms dealer licenses, he was not exempt from registering his weapons. "Given the level of what we've found - all of these are fully automatic - in a post 9/11 world, it raises our suspicions," the superintendent said. Norris said that possible links to terrorism weren't being ruled out. Tabassi, a U.S. citizen, was born in Iran.

In an interview from his home last night, Tabassi said the charges were a result of discrimination. "This is America. The last I looked people weren't discriminated against because of their religion or race, but I guess I'm wrong," he said.

He said state police had "ransacked" his home and were "lying through their teeth" about the allegations. All his firearms are registered and were locked in his gun shop and his bedroom, he said. When he went to see state police for what he thought was a job orientation as an agent with Homeland Security - it turned out to be his arrest - his bedroom door was locked, he added.

"I am only loyal to one country: the United States," Tabassi said. "What kind of ties do I have with terrorists? This is baloney. This was not fair."

Tabassi was in the news in 2001 after leading police to a conspiracy to commit murder involving Scott Caruthers and other members of Beta Dominion Xenophilia, a Carroll County group that reputedly believed Caruthers was a space alien and a messiah who would save followers from catastrophic "Earth changes."

Tabassi, a former bodyguard for Caruthers, went to state police after he said group members solicited him to commit the killings. Five group members, including Caruthers, pleaded guilty to charges of conspiring to kill "enemies" of the group.

Yesterday, at a morning bail review hearing in Carroll County District Court, Tabassi interrupted his lawyer, Fred S. Hecker, and adamantly told Judge Marc G. Rasinsky that he operates a gun dealership from his home and is in lawful possession of the weapons.

"My home is a legitimate gun dealership," Tabbasi said on a video feed from the detention center. "I have done business with the ATF ... and Maryland State Police. The downstairs is licensed and zoned for that."

In arguing for bail to remain at $250,000, prosecutor Allan Culver said houses with so many machine guns "are a danger to the community."

Rasinsky lowered Tabassi's bail to 10 percent of $25,000.

Later at the news conference, state police confirmed that Tabassi's basement is licensed as a gun dealership and that he has held a firearms dealer license since 1993. But they said that 17 machine guns found at his split-level home were unregistered and unsecured, and they denied doing business with him.

Cpl. Frank Lopez said Tabassi had been under investigation by the firearms enforcement section of the state police since early last month. Authorities were tipped off that Tabassi may have been in possession of an unregistered machine gun, Lopez said.

State police took him to the Westminster barracks for questioning late Tuesday morning. After serving Tabassi with a search warrant on his 1992 Mazda Protege, state police found a loaded .40-caliber Glock pistol in a fanny pack on the front seat. Tabassi had a Maryland permit to carry a handgun, but it had expired, police said.

State police took Tabassi back to his home, where they served another search warrant, Lopez said. They found a girl, the sister of a woman who was visiting Tabassi, sleeping in a bedroom. On the bed next to her were two loaded H&K MP5 machine guns and a loaded Glock pistol, police said.

Anyone who acquires a machine gun must register the weapon within 24 hours and renew that registration annually, state police said. Dealers are not exempt.

Two points:

1. On the local news they had him yelling about how he was being persecuted because he is a Muslim. *sigh*

2. How the h*** did he manage to get a Maryland CCW Permit? Because he was doing business with the MSP?

Boy, this is gonna go over great. One of the (near impossible to get) CCW holders has unlicensed machine guns in a case where "terrorism isn't being ruled out".

And this on top of the Baltimore white power guy (still in jail on 2 million bail,btw) who they said was "stockpiling gun powder".

In my opinion, neither case will lead anywhere, but thats not what the local antis will remember!:banghead:
 
Let me get something straight: if he's a dealer and sells to police or the military, he's allowed to have post-86 machine guns, right? Now from the story, it sounds like poor gun safety was being exercised, leaving them out and unsecured, in a child's room no less.

There's something on the order of 10-15 gun dealers in MD with permits. There's also a few gun collectors and a few gun smiths with permits, as well.

Just had a thought here - Is this a Maryland registration? From what it sounds like, he's a legit dealer, maybe a legit Class III dealer, but he missed something about having to register stuff with the state...

I had the same thought.
Especially because:

I'm pretty sure that Federal charges for possession of an unregistered machine gun are felony.
 
I’m too cynical I guess. Every time I see this kind of thing I think it’s just another case of LE nabbing a guy to make headlines who just might be innocent.

I was such a supporter of LE for years. Now I can't find a grain of salt big enough......

MMMMMMMM, MP5's!!!! and whats that stainless one in the middle? has a ventilated barrel shroud, looks rather long? is that a sten in the bottom corner? can only see part of the barrel and the folding stock.

wonder if the ATF will arrest other firearm dealers, after all, they are a 'danger to the community'! :rolleyes:
 
There's something that smells in this story somewhere...I just can't figure out if it's from the Maryland law enforcement guys or this FFL holder. Probably some of both.
 
Looks like he's got a SW 76 (or copy), a Madsen, an AC556K, an some variant of a Ingram M11. The first three (if functional) are either full-auto or short barreled rifles (covered by the same statutes as full autos).
 
Sounds like state charges. Like they were registered with ATF but not with the state.

With the lapsed CHL, it sounds more like he was lax with his paperwork more than anything else.

Damn shame.

Reminds me. My permission to carry expires in December. Time to start the renewal process.
 
No, he says that the cops are lying through their teeth about
1. Whether they're registered (presumably state and federal according to him, though it is certainly in the realm of possibilities that they were registered fed, but not state), and
2. Whether all the guns were locked up, and not by the sleeping child as alleged.

So it's "he said; they said" - why do at least 2 posters here believe the police and not him? Because police don't lie? Ha. We shall see. Who knows who's lying. Somebody for sure. But I'd give damn near anyone the benefit of the doubt over an LE any day, especially in Marlyand, especially a licensed to the hilt gun owner (i.e. law abiding), and especially as against a "middle-eastern-looking" person, when the police are looking for an excuse to bust people to look like they're "winning" this farse known as the "war on terror".

Second point: If one is a class III dealer, and one procures a gun for re-sale, and not for one's private collection, is one even required to "register" those in one's name? Why should you have to, if they're for re-sale? I dunno - just thinkin here....

Finally, I hate, Hate, HATE IT when the stupid ^%#$!@ cops spread out all the guns of the "arsenal" of the "bad guy" on a table like that at a press conference - oooh, look at all the evil guns. :fire:
 
One other point.
My guess is this dude was a legit dealer. Possibly he didn't keep his state records correctly (whatever that is) and the SoM therefore has seen an opportunity to nail him and did.
That shows that in the SoM they are taking BG evil gun dealer/owners and evil guns of the street. (remember..it's for the children)

What are the chances this fellow will ever see his inventory again?
I'm guessing 0 percent.

That much $ loss plus by having his inventory taken and crushed and the legel fees will put him out of business even if he did not break a law.

Great country sometimes ain't it.

Someone please educate me. I see submachine guns and automatic rifles in the picture but no what I call machine guns. Where are the machine guns.
I quess what I'm asking is some please define "machinegun"

Federal law defines a machine gun as any firearm that is capable of firing more than one shot per pull of the trigger.

spreading them all out on the table was the shock and ohhhh..whats the first thing you think about when you see a bunch of guns of this type displayed on a table...the media does the same thing,hold up a scary looking gun for all in the court room to see.its their way of pressing the issue.frightening the sheeple.the bit about "they think hes a space alien" really cracked me up though(ever had 7 up shoot through your nose after gulping and then trying to laugh?).someone has been watching too much television-again.theyve pulled the stoppers out of this beaut.reality check.could the awb have anything to do with this?smells like it.machine guns fire a rifle cartridge at the rate of more than 1 shot per pull of the trigger...while the submachine gun fires a pistol round.
