A Bisbee man has been charged with assault and interfering with a federal officer for allegedly tackling a U.S. Border Patrol agent who had shot his dog.
Gil Nelson, 47, made an initial appearance Wednesday at U.S. District Court in Tucson on the charges stemming from an incident a day earlier in which Agent Jeremy Poser suffered a sprained little finger.
According to a complaint filed by U.S. Attorneys, Poser was responding to an activated sensor in a wash near Nelson's home Tuesday afternoon when two dogs ran toward him.
"Poser started to walk backwards but the dogs kept running towards (him)," the complaint says. "Poser felt threatened and shot one of the dogs with his service weapon."
The injured dog belonged to Nelson and ran toward his home after the shooting. The complaint said Nelson, running out of the house, jumped on Poser's back, putting him in a headlock while pulling back on his finger.
Poser pepper-sprayed Nelson, who then let go, but grabbed the agent's hat and sunglasses before running back inside the house, the complaint says. Nelson was arrested after more agents arrived at the home.
U.S. Attorneys spokesman Wyn Hornbuckle said Nelson remains in custody pending a detention hearing Friday.
The agent's version of events was disputed by Nelson's friend who was at the home when the incident happened.
Debbie Norman said she was in the house with Nelson when they heard a very loud shot and heard the dog yelp.
Nelson brought the dog inside, then ran outside with Norman and another woman. She said the agent was running away.
"When Mr. Nelson screamed at him, the guy turned around and Mr. Nelson knocked the gun out of the guy's hand," Norman said. "Then the guy Maced Mr. Nelson, who fell on the ground, and the guy got on his radio and said he had just been attacked by three citizens. The man lied from the very beginning."
Norman said Nelson had confronted another Border Patrol agent earlier Tuesday and told him not to come onto his property, then called the Naco Border Patrol station and told them he didn't want agents coming near his home.
"Now Mr. Nelson is in jail, and I feel that it's a case of retaliation and harassment," Norman said. "I feel like they set him up."
Tucson sector spokesman Jesus "Chuy" Rodriguez, saying the Border Patrol is investigating the incident, said he could not comment on the specifics of the case.
 
It's too early to draw any conclusions based on the conflicting stories. So, let's not go down the route of "lying scumbag versus honest cop" or "honest citizen versus lying cop" quite yet.

Its called a chain, if your dogs are the type that would attack people put them on one or get a fence.
 
Whether the dog shooting was right or not, the home owner shouldn't have attacked the agent.

So I wonder just how close this was to this guy's house. Was it close enough to warrant the agent knocking on their door first?
 
Oh, sure, citizens they chase and pursue, illegal aliens, bah, no big deal.

Oh wait, yeah, he was chasing aliens when this guy's dogs attacked him. I can't count how many, "what load for attacking dog" or "had to shoot a dog today" threads I've seen here, so what's the problem with a guy in uniform doing the same?

I don't see anything that Poser didn't do right.

What kind of terrible ironic joke is it for a guy to have the name poser?

Loose dog approaches armed man = whatever happens to the dog is the dog owner's fault.

Unarmed moron attacks an armed man who just used his weapon = whatever happens to the moron is the moron's fault.

Person who gets into a whizzing match with law enforcement = foolish person bound for trouble.

There's a right way and a wrong way to handle disputes with law enforcement. I guess this was the wrong way.
 
If, and only if, the bullet actually did enter from behind, and no other blood was found away from the door (blood could be near the door even if the dog was shot a mile away), then clearly the agent shot at a fleeing animal. This one is starting to smell a bit like harassment, but either way, the homeowner was an idiot to run after a man in uniform who just fired a gun. If the cop is straight, then he is commiting a crime. If the cop is croked, he is still commiting a crime (no defense argument here). Either way he is lucky he wasn't shot.

Having said that, if the BP guy shot the dog in the back, as it were, RIGHT after he asked them to stay out of his yard..........you gotta wonder.

Hmm, this is not looking good for the agent.

Blood stains right beside home? Bullet wound channel entering from rear? Sounds like the agent is a two-bit liar who shot the dog in spite.

Still, I wasn't there. I'm glad the dog survived. If the agent was at fault, the BP needs to pay the vet bills.

Shot fired close enough to dwelling to rattle windows. Medium sized pet dog shot from rear angle. Previous encounter with parties in question. Homeowner's first response is to care for the dog. Federal agent beating hasty retreat when caught by homeowner. Oh yes, I feel MUCH safer knowing these nitwits are on duty.
 
Jajaja, that was so funny.

I would not think twice if a dog attackes me. I would shoot right away. But again im not a Border Patrol, when you wear a uniform you have to act with a little respect. :neener:
 
Not wise

Asaulting any Law enforcement officer is as wise as peeing in a 220 volt receptacle. Even if the officer was wrong so was the dog owner. I had a similar incident where i got off with my 11 year old son at a new car sales lot at about 10 min prior to 5 o clock to check a car I liked and my son was attacked by the security dog that were release by the security guard(he was assuming the front gate was locked). We were not the only clients still in the car lot:eek: I stood between the dog and my son and already had my hand in my gun when the owner of the lot came out took the dogs back and yelled at the guard for being careless. I love animals but i love my kids more...
