I live in AZ and have a Companion BP. I was wondering if anyone knows what the concealed carry laws are. It's listed as a non gun so it shouldn't make a diff one way or another but I'd like some advice. Thanks

BP means "Black Powder".

I'm not sure about Arizona laws, because they're all different. That's what you will need to check.

In California, I can mail-order a BP firearm, etc. For the purposes of commerce, background checks, etc., it's legally a non-gun, like you said.

HOWEVER, the laws about carrying a gun are completely separate. They have their own definitions of "firearm" and "loaded". For the purposes of carry, a "firearm" is anything that fires a bullet by means of an explosive propellant. So, as soon as I load a BP revolver, the same laws apply to it as would apply to a cartridge gun. (Loaded, however, in California, means "loaded and capped." If you take the caps off, it's not legally loaded.)

ADDITIONALLY, the Fish and Game Code has some different definitions, particularly WRT the definition of "loaded firearm", and "in a vehicle."

Now Arizona's laws are different. But they could be written in many ways.

Check them!

Just know that the Federal "non-gun" definition does not necessarily apply to loaded carry, either open or concealed.

Armedbear - I figured that's what he meant, but I'm never sure.

I'd guess exactly what you said - they might not be classified as guns as far as sale goes, but a cop is definetly not going to feel that way of he or she sees you carrying it or deals with you after you have to use it.

There are also specific definitions of "open carry" that vary according to the text of state laws.

In California, the text is "carried openly in a belt holster."

It's an interesting requirement. Some handgun hunters (carrying without a CCW permit) use shoulder holsters because their guns are large and long. Does this change how and when they can legally carry? I don't know. I don't own a shoulder holster at the moment. It just illustrates that you need to read the law and consult an expert if the law is unclear.:)

This comes from the Arizona Concealed Weapons Permit Unit page that defines what a firearm is.
"4. "Firearm" means any loaded or unloaded handgun, pistol, revolver, rifle, shotgun or other weapon that will expel, is designed to expel or may readily be converted to expel a projectile by the action of an explosive."
I suspect that when you contact them and ask, they'll tell you a BP handgun requires a permit to carry just like any other handgun.

Another thing...

Those little guns fit in a variety of belt buckles available from NAA.

Is that, or is that not considered "concealed?" That, also, would be a good question to ask.

Thanks to all of you. I really didn't know. In Az we can openly carry a weapon but I wasn't sure on the CW part. To your question ArmedBear, I think as long as your shirt or jacket doesn't cover it it is considered open carry here. Thanks again.
