I'll be happy to call an authority for the whole group if nobody hears anything for another week. That would be June 13. Let me know and I'll handle it.

I really think this is something that needs to be done. This may be all that is necessary to kindle a fire under Raether.
 
It might be necessary for individuals to file their own complaints for the sake of authenticating them. If one person can determine the appropriate authorities to complain to then he can inform the others so they can file a complaint too.

Gentlemen,

As promised, I contacted the Oshkosh PD. I explained our problem and they paid a visit to Mr. Raether. Apparently, he was surprised to see the law at his door and admitted that he was woefully behind in his business, giving a line about being swamped at work, etc, etc, etc. I don't believe his claim of having "never received any phone messages" but I guess it's tough to make up stories on the spot. Anyhow, he told the officer that he would start sending us back our property so, for what it's worth; at least he can't claim ignorance. I hope this solves everyone's dilemma.

Many thanks to you. This is exactly what I had hoped for. Lets hope he refunds our money as well as returns the guns. I fear that he has probably spent the money and no longer has it to return. I pray I am wrong.

Whether he spent the money or not is not your concern, or anyone elses who sent him their hard earned money in good faith.

He did not fulfill his end of the contract in a timely and satisfactory manner, and you want your money refunded. He is not only morally liable to return all money requested, he is legally obligated to do so.

He owes everyone their money, and must pay them back, whatever the personal consequences are to his private finances, period. He can take out a small loan, run up his credit cards, sell something, do whatever he has to do to come up with the money, thats just life, and it's not anyone elses concern or bother how he does that.

Besides, a reputable company will cancel your order and return your money to you for no reason whatsoever, you don't need a reason to cancel an order. Sometimes people overspend their money, forgeting to include an expense or two, leading them to think they have more money avialable in their account(s) than they actually have. In such cases, sometimes, they need to cancel an order they placed, in order not to get into some sort of overdraft situation. You don't have to explain that to the companies you do business with, all you have to do is cancel your order, and request a refund, it's just that simple.

I think the concern was more about the likelihood of getting the money back rather than the moral imperative.
 
That's pretty nice of the local PD to expedite the complaint and to go and pay him a visit. That puts both the PD and the proprietor on notice which is a good first step toward getting some positive results.

Since this mail fraud I would contact the post office and perhaps the BATFE. Nothing like cranking up the heat on a dead beat. Be happy if you get your guns back.
 
Well guys...

If turning up the heat a bit is your perogative at this point.....

A) He promised an officer he would make good on his buisness dealings.

B) The officer filed a report

C) All of you go get a lawyer, and share the expense as a group

D) Get a judge to declare him in default.

E) If he doesn't pay up, plus legal fees and lawyer expenses (He has to pay for those too!)... THen...

F) Have the court issue a siezure order...

This legally allows you to seize everything he has, sell it all off, take what is owed to each of you, and, he gets the bill for the expense of it all.

That will teach him a lesson he will NEVER FORGET.

At this point, I think we just need to wait 30 days or so and see if he makes good on his statement to the officer. If no one receives any guns and/or money in the next month or so, then perhaps further action will be warranted.
 
I Just Got My Parts From Mr. Raether!

Gentlemen,

I just got my parts in the mail from Mr. Raether, along with an apology note. I hope you all receive your property soon as well.

I just got an email from T. Raether apologizing about how he had to work long hours and had too many orders to handle. He said my pistols were finished and he asked to verify my address so he could ship them.

Finally, I can put my Walker back together.
 
I just picked up my package from Tom Raether. There was no note, just a Pietta booklet and the pistols he had worked on wrapped and padded in old Midway catalog pages. As I opened the box, I was just hoping the pistols would be in the box, much less the work done on them properly.

The bluing on the Walker frame looks sharp and ranges from a purple to a medium blue. I blew the dust off the barrel and cylinder and installed them and gave everything a wipedown with Ballistol.

The Cowboy Action Special Pietta 1860 Colt: The grips have been refinished to a deep red oil finish. The receiver and load lever have mottled brown and gray case hardening, the barrel has a gray/blue solid color, and the cylinder has a solid purple/blue hue. "Defarbing" was part of the package. The only original markings on the pistol are Pietta's proof markings by the barrel wedge and Pietta's proof markings above the trigger guard on the right side of the receiver and the serial number in front of the trigger guard on the bottom. On the left side of the barrel above the load lever there's very faint remnants of lettering "BLAC" and what appears to be the bottom half of "CAL." still sharply engraved in the metal. The barrel is covered in steel wool scratches.

The trigger pull is excellent and the original factory nipples have been replaced with Treso nipples as part of the package. The rear sight notch on the hammer has been squared up, but it's raining outside, so I can't shoot it yet.

I'm happy with the work overall. I didn't care about the defarbing, but it was part of the package. I like the overall finish on the 1860, but don't like the scratches on the barrel. It looks like what it is, someone took the original finish off and reblued it, but I got the pistol to shoot, if it looks purty, it's a bonus.
