I live in New Jersey and am finally proud of my governor and am glad I voted for him.
 
Yeah free but still no justice. Commuted sentence means he's still guilty, and a convicted felon.

I'm sure he is very happy with this rather than the alternative however.

The Governor took the sleazy way out though, not sure that's worth a celebration.
 
This is a mediocre end to a very sad story of yet another victimless "crime"... and yet another decent American falling victim to illegal "laws". I'm glad he is going home, but it does nothing to address the real issue.
 
Its a step in the right direction, but its not over. He has to win his appeal, which i am sure he will. I want to thank the NJ2AS for all the work they put into this, even though the rally was canceled. We know we cannot stop here. There is more to come so stay tuned!!

I really thought the governor would give Brian a FULL PARDON. It's good that he's out of prison, but as some have eluded to here, he won't be able to own a firearm legally anywhere in the US anymore. Is there a way for him to appeal the ban on his ownership of firarms, or will he be banned from ownership forever? What if Brian loses the appeal of the conviction?
 
Like TR and KB stated, this is better than bad, but far from acceptable. I told Governor Christie why only a full pardon, (as if he needed to get this info from me,) and that his decision would determine whether I would stand behind him in his presidential bid, and whether or not I ever care to visit New Jersey again. I'm sorry, but this was pass or fail, and he didn't pass.
 
I'm glad he's out of jail.

Nonetheless, commutation isn't an indication of political bravery and integrity. It's a half cheeked act of political cowardice and calculated act of triangulation designed to gull the gullible.

The just points to award the governor is to damn him with the faint praise that it's less cowardly than whistling tunelessly and looking the other way.
 
Chris Christie, while a darling of the Tea Party, campaigned in the 90's as a proponent of NJ's gun control laws.

Some states have a path for a restoration of rights but I would not be surprised if NJ wasn't one of them.
 
I believe there are things his lawyers want accomplish with an appeals process. It could even be better!!

If he loses the appeal he'll have to take up archery.
 
To clarify.... a full pardon was never really going to be an option. He was guilty of the hi-cap magazine possession... no way around that. The other charges weren't warranted, as he was protected under the moving exemption (well, for the most part... technically, he wasn't covered for the HP possession - but again, that's a technicality of the law).

So - even if those other charges were dealt with appropriately at trial, he still would have been found guilty of a 4th degree crime. He would not have had to do any time for that conviction, as 3rd and 4th degree crimes do not carry a presumption of incarceration (unless there are other aggravating factors - which in this case there were not). Therefore, a commutation of sentence corrected the injustice that occurred at trial (I know, I know.... the whole thing was unjust... shouldn't have ever happened... bad laws... etc. etc. But, we have to work with what we have here).

As for the restoration of rights... NJ is actually better than a lot of states in that respect. Convictions can be expunged after a period of time (5 years for a disorderly persons offence, 10 years for a crime). Contrast that to a state like PA - where there is no expungement process, and your only hope for restoration is an executive pardon.
 
wow, im actually surprised at how well the media presented that story....

...i was half expecting "Armed Felon set loose after serving only 4 months of a 7 year sentence.."
 
hasn't nappen been his attorney all along? when the dust finally settles i would love to hear why the kept Aitken off the stand and if he would change that strategy now

In NJ, yes. We don't have misdemeanors and felonies... we have disorderly persons offenses, and degrees of crime. Possessing a hi-cap mag is a crime of the 4th degree, and punishable by 18 months.

So, that's the bad news... possibility of an 18 month sentence makes you a federally prohibited person, so no 2A rights. The good news is, NJ allows for (most) convictions to be expunged, meaning a restoration of rights is possible. The other bad news is, you have to wait 10 years before getting a crime expunged.
