Brother dragging me to pick up wife in Newark

I'd like to know my options here.

I live in PA. So does my brother (few miles away). I'm a night owl, he isn't. He needs to pick up his wife at the international airport in Newark, NJ tonight. He just called me and asked me to make sure he doesn't fall asleep.

I have PA license to carry. I can't carry in NJ, but can the gun be in the car unloaded? and how so?

Leaving in a few hours, just wondering what options I have.

NJ law (in my non-attorney understanding) is that carriage of a firearm, even unloaded and locked in the trunk, is only legal without NJ permit/FID/whatever if you are on your way to/from a range for purposes of target practice. That's with no bullets in the magazine, by the way.

Worst case scenario: you get in a wreck in NJ, and the police find the gun in the trunk. You now have a felony weapons arrest on your record, regardless of how the trial goes.

FOPA should protect you. You are going from a place where carry is legal (your house) to a place where it is legal (your house). FOPA stipulates that the gun must be in the trunk, unloaded, and locked up if possible, but if you follow that guideline you should not get in trouble. FOPA overrides NJ's bass-ackwards laws.

Plus, the gun unloaded locked in the trunk of your car does you no good at all. As others have said, give the gun a break in your safe. It's tired and deserves a night off.

FOPA says it OK for transport if you are going from a place where you can legally own to another place you can legally own.

Round tripping to Newark airport doesn't meet the criteria and if you get pulled by the lovely NJ police without a FOID your up the creek without a paddle.

The only time this would work is if you were going to Newark airport to then fly on to AN Other place.

FID in NJ is only for possession and purchase of long arms. According to the law, it's unlawful to possess a handgun without a permit to carry. Exceptions are made for travelling to/from a range. Handgun must be locked in the trunk, or in a locked case if no trunk exists, and ammunition stored separately. The law is mum on having removable/detachable magazines loaded with ammo.

FOPA does NOT apply... travelling from his house in PA, to his house in PA, by way of Newark airport? That's not gonna fly. If discovered, he'd be arrested.

Again - FID only allows possession of an unloaded rifle or shotgun. It's useless for handgun possession. And, since it's virtually impossible to obtain an NJ permit to carry, possession of a handgun in NJ is by default illegal, unless you fall into a few narrow exceptions (possess in home, transport unloaded/locked up to/from range, transport from place of purchase to home, to/from place of repair... things like that). NJS 2C:39-5 and 2C:39-6 (paragraphs e, f, and g) for the particulars...
