Brother in law lives in CO, me in NJ

My brother in law lives in CO and I live in NJ. He wants to sell one of his handguns. If I go visit him, which states law do I follow? In CO I only need a permit to carry. No id/permit to purchase. In NJ I need the FID to purchase.

So when I go visit him in CO could he legally sell me the gun? And as long as I have my permit to carry I should be fine when I return back to NJ?
 
You follow federal law ,which says no purchases unless you are a resident of the state


The gun has to be shipped to an FFL in your state and then transferred to you according to the laws of your state

In order to buy a gun across state lines, your Brother in law will have to ship the handgun to a licensed dealer in New Jersey and you'll have to have the dealer transfer it to you.

In addition, you still need to abide by New Jersey law once you return to New Jersey.


The only thing that would be remotely close to legal is if you got to Colorado, purchase the handgun from your Brother In Law, the gun STAYS in Colorado and you can come out and visit it (or just move out and become a Colorado resident).
 
Welcome to the wonderful world of being an abused, second class subject of the dark, collectivist state of NJ.

To legally obtain a handgun, you will need to obtain a Firearms ID card, a process involving fingerprints, forms, and many months of waiting.

You will also need to obtain a Pistol Purchase Permit, which you can file for at the same time as you file for your FID, down at your local police department.

Don't bother filing for your carry permit, you're not going to get it.

Having done all that, and with your papers in hand (remembering they expire in 90 days) you must find a local FFL willing to do the transfer, to whom your brother in law would ship the handgun.

The FFL will then examine and collect the papers you have, cause you to fill out more papers, and then make a phone call to perform yet another background check.

If all that works out, you will be grudgingly permitted to lock your unloaded handgun in your trunk, and drive directly home with it.
 
Obeying NJ law means "bend over."

You'll need to complete a Firearm Purchaser ID Card application and check the Pistol Purchase Permit box.

You'll then bring a money order or cashier's check for the exact amount to the police station.

They'll fingerprint you if it suits their schedule, and charge you for the service in most cases.

State law gives them 30 days to return you either a FID or a denial, but in reality it's more like double that. Even more in some towns. And there's nothing you can do except call the police and bleat like a lamb.

Once you have your Pistol Purchase Permit, you have 90 days to use it. You can bring it back to the police for a 90 day extension if needed.

If you'd like a permit to carry the handgun concealed, forget it. There has to be a verifiable threat to your life, documented with police reports.

These are "reasonable, common-sense laws" that earn NJ good Brady ratings.
 
Of course you could always see if your BIL will let you crash on his couch until you find a job out here in Colorado and just move back to America :)
 
Yeah, I figured I would have to bend over for my good ol state. I think Ill wait till I move out to Texas which I plan on doing in the very near future. I was planning on waiting till then to purchase anyways but then my BIL told me abuot him wanting to sell. Thanks everyone!
 
If you move to Texas that eliminates a lot of the BS, but not all of it.

You'll still need to have your BIL ship the gun to an FFL in Texas ... of course then you just go down to the FFL, fill out your 4473, pay him $20 (or so) and after your NICS you walk out with your piece.
