If your doing a FTF handgun sale, with both parties from the same state, do you still have to go through an FFL and 7 day wait list? I'm looking specifically in VA or DE? Or is this just a MD rule? How about an AR-15 or AK-47 clone? Thanks

Maryland is quite restrictive and all handguns (private sale and otherwise) must be run through a dealer or the state police for a background check. They have a list of rifles as well and the AR's, I believe, are on that list. So you must go through a dealer or State Police.

Any out of state handgun purchase must be routed through a Maryland FFL dealer. I am not sure about long gun requirements as in most states, you can purchase long guns if you are not a resident.

I would check the state requirements. I am not sure about the 7-day waiting period. Call the State Police and they should tell you straight.
 
Let me ask in another way.
If I am a resident of Va and want to buy a handgun from another Va resident, do I still need to go through a FFL? Same scenario, but with an AR15.
 
Selling a handgun across state lines is a crime if an FFL is not involved. If you are an MD resident and you sell or transfer a handgun to someone outside MD without going thru an FFL, you've committed a crime.

If you are a VA resident, private transactions between gun owners are perfectly legal. The only restriction is that you are not allowed to sell a gun to someone you know is legally ineligible to own the weapon. But you're not required to ask. The responsibility is on the buyer to not buy a weapon in a private transaction that they're not legally entitled to own. If in doubt, write up a bill of sell which includes a statement that the buyer swears he's legally eligible to purchase the gun.

Thanks. I am currently a resident of MD but I'm only a few miles from the VA border. With the current situation in MD I was thinking of going a few miles down the road and become a resident of VA.
I was just wondering on VA law if there was any paperwork or waiting period if I did a private transaction.
