Please help me understand this topic. I know that if I buy a gun and have it shipped to NJ, where I live, I need to use an FFL? But what if I drive to Penn, or Virginia, or happen to be in Florida for vacation. Can I buy a gun based on the local laws and drive it home? Is there a difference between doing this for handguns or black powder?

I hear that in PA black powder, even revolvers, aren't treated like regular handguns and you can just buy them. But I don't want to drive home with an illegal gun. What if I find a shotgun at a garage sale in virginia? Can I just drive it home?

NO you cannot buy a gun in Florida and drive back to NJ with it legally. And I'd say the person in Florida that sold to a person that is not a resident of the state the sale takes place in may get in trouble too.
 
Under federal law, long guns purchased out of state must go through an FFL in the seller's state or the buyer's state.

Handguns purchased out of state must go through an FFL in the buyer's state.

States (especially restrictive ones like New Jersey) can and do add restrictions above and beyond the federal ones.
 
Since you are a NJ resident, you will not be able to purchase a firearm out of state.

Solution: Move to Pennsylvania.
 
Yep, the kicker that really gets you is your State

If you lived in most other states you could buy a long gun out of state through and FFL and be fine... but I don't think NJ will let you legally do anything with out it going through a NJ FFL.

Long gun purchases by out of state residents are prohibited in NJ. There is nothing there saying NJ residents cannot purchase long guns out of state.

The Federal law allows out of state purchase of long guns "as long as it is legal in both states". You can't go to another state and purchase a M1 carbine or any other firearm that would be illegal in NJ (although some places will sell you one). You must buy the long gun from a FFL (not a private individual) and have a NJ FID card to make a long gun purchase out of NJ.
 
I know you can buy long guns outside of NJ.. I've bought a couple in PA. I doubt you could do it somewhere as distant as Florida however, as NJ has its own paperwork you have to fill out. All the PA FFLs that I know of (admittedly not many) have the NJ paperwork. And you'll obviously have to follow all of NJ's silly rules.
 
So wait, what if you go to say PA, purchase a long gun that's illegal in NJ (let's say a civie AK clone) but DON'T bring it back to NJ? Can you be persecuted under NJ laws?
If so, it's truly disgusting that they'd force their laws on a person outside their jurisdiction at the time.
 
I know a few seller in PA that will not sell a gun to a NJ resident that they know to be verboten in NJ. The a aggravation it would cause, if they were caught, just isn't worth it.
 
Wow, I knew NJ was bad, but that's ridiculous. Does anyone know if any other states prohibit out of state purchases by their residents?
MD dissalows the purchase of certain rifles and shotguns without going through a MD licensed dealer by non-licensees (an FFL, not necessarily a state "dealer"), so when in VA a MD resident could by an SKS from a VA FFL, but not an AK47 unless the AK47 was shipped to the MD licensed "regulated firearms" dealer for transfer like a handgun would.

As I understand it, it would be an illegal transfer on the federal level, not the NJ level because it did not occur inside the borders of NJ.

There's a lot of bad information in this thread.

I'm not a lawyer, I'm an informed layman, and was a gunowner in the Dark & Fascist state of NJ, who legally purchased guns out of state when I lived there.

Here's the deal:

As an NJ subject, you are permitted to purchase NJ legal long guns out of state from an FFL.
You may not purchase any gun other than through an FFL.

The FFL is required to follow 3 sets of law: Federal, PA (or whatever state he's in) and NJ's (the purchaser's state)

This means that you will have to show a valid NJ FID w/ an address that matches the address on your NJ DL. You will also have to fill out NJ paperwork, which will remain on file with the FFL, in addition to the usual Federal paperwork.

You may not purchase a handgun out of state, although you can have it sent to an NJ FFL, and purchase it in NJ, after showing FID & PPP.

You may purchase BB guns out of state, and bring them back with you.

I haven't the foggiest notion what to tell you about black powder handguns.

Since cap and ball revolvers are not regulated bythe feds (under the GCA or the Brady law), and since they are legal to buy in PA (and MD too), then as long as you do not bring it back with you to NJ it should be legal. If you could find a place to store it in PA or elswhere it is legal to possess, then that might be a way to go.
The cap and ball gun would not be illegal until you crossed the NJ border with it if they are illegal in NJ.
