Cap and ball idea

I was just thinking, if you made a cartridge conversion type cylinder for a .36 revolver, but for a bullet casing slightly larger than it was designed for, but made the muzzle end of the cylinder the right size so that a full cartridge could not fit, but you had to used a .36 ball rammed in to complete the charge, would it still fall under the exemptions in the law for a black cap and ball firearm? With this setup, you could load powder and wad in the bullet casing and have an easy load that could be made to be water proof, but still have to ram a ball in to complete the charge. The water proof casing could have a good advantage in the field, and the result might still not be considered a firearm.

No. A metallic cartridge is a metallic cartridge, no matter how odd it may be.
 
It depends entirely on how the local DA (or local judge) interprets the law. Offhand, I'm guessing they would not be amused...
 
Is it "metallic cartridge" or "conventional ammo" that falls under the law?
If a particular ammo is no longer produced (or, in this case, never really existed) is it regulated?
