Carry in Texas

I would think that the liability would have to do more with the black powder than the weapon.

Could a DA make the case that it is an explosive device?
 
Given states where no laws actually prohibit any of this, it's just odd that as far as the non-firearm, firearm is concerned...

  • Order through the mail? Perfectly fine, go right ahead.
  • Gift across state lines? No problem at all, feel free.
  • Alter barrel length or otherwise convert it? Have at it.
  • Carry it on your person? Uh, no... you shouldn't do that, although it's just as legal.

None of us could imagine getting arrested and prosecuted for any of the first three on that list, but that last one, although legal, is a big no-no.
 
And that's why I think you could get away with it in Texas, legally.

The unintended consequences are worrisome though. If it got to be a "known workaround" I could see a quick change to some definitions to close that "loophole". Remember, a loophole is when you follow the law completely and someone else doesn't like it :)

I'd rather spend the energy doing away with the entire permitting process and get Constitutional carry for any law abiding citizen.
 
I have "side-step" question about this...

What if one was carrying this non-gun and was forced to use it in self-defense... some sudden random act of violence?
