CC, Idaho, Under 21

Hi all,

I have a Maine, non-resident CCW permit, am 19, and spend a lot of time in Idaho. I live in NC, am moving back to WA in the near future. I'm working on getting the right permit for NC, but am investigating Idaho's laws.

I read their statutes that say they honor EVERYONE'S concealed permits, just you have to have it with you, etc etc. My question is can I carry concealed in Idaho with a out of state permit...UNDER 21.

I know sheriffs have the authority to issue to 18 and up, and I even called the county where I spend the most time (Latah County), and she transferred me to Lewiston Highway Patrol...who then transferred me to Lewiston Police Dept...who then gave me a number to call back.

Now, short of a lawyer, does anyone know if CC'ing under 21 with an out of state permit is legal? I know a DA can prosecute if they want to, and it sometimes has to be fought in court, but is anyone reasonably sure?

As usual with these kind of questions on a gun forum, you're going to get a wide variety of answers and opinions. You will probably end up more confused then you are currently.
I think you started out in the right direction by going to the source. (i.e. Local Police.) Stick with it. I would think about going the the State AG's office for the final word.

killermonkey21,you have posed a most interesting question.
Checking the pertinent Idaho Statute,Chapter 33,Firearms,Explosives and other deadly weapons,nowhere does it address your question.
Now,for an Idaho resident to apply for CCW,the minimum age is 21.But for a non-res under 21 carrying a legal license from a state,say Indiana or Maine ,which allows 18 year old CCW,would you be good?
Since the law does not seem to address it, my answer would be yes.
But without a firm AG opinion or further research to completely clarify,you must be sure, of course, before proceeding.

I'd actually be pretty interested what the AG says on this. Idaho says no CCW till 21, but also says they honor Maine's CCW which is obtainable at 18.
 
In general, one who has a valid out-of-state CCW is subject to the CCW (and all) laws of the state in which he's carrying. So, for example, if the state you're in requires that you declare your CCW to an LEO during, say, a traffic stop, you must do so, even if the state that issued your CCW has no such requirement. You must also abide by the laws of the state you're in with regard to such things as places in which carrying your weapon is prohibited, etc.

Similarly, it's likely that if the state you're in sets a minimum age for issuance of a CCW, and if you're younger than that age, you might not be able to carry even though your CCW was validly issued under the laws of the issuing state.

The real point of all this is that it can be complicated, and if your freedom is at stake, the Errornet is a lousy place to try to get advice. If you wind up getting arrested, neither the cop nor the DA is going to be impressed by, "but the guys on this Internet gun forum said it was okay."

Check with the Idaho AG or find an Idaho lawyer who knows about the gun laws (an Idaho RKBA organization may be able to provide a referral), and pay him a few bucks for his advice. Among other things, you'll know who he is, and you'll know where to find him if his advice gets you into trouble.

You don't know who we are, and if our advice gets you into trouble -- lots of luck.
