My point is that many people believe that a a spouse not only cannot be compelled to testify against the other spouse, but may be prevented from testifying. They cannot.

My wife is ranchers daughter and shoots a rifle better than I do... I make a point of not doing anything that might cause her to voluntarily testify against me... or meet me at the door with a shotgun. ;)
 
Even if a spouse cannot testify against you an experienced cop doing an interrogation can more likely than not get something from her.

I was not and am not attacking you. I find you to be an intelligent man with sound ideals (mostly). I would not hesitate to make you part of my defense team if needed. I do agree that an expert witness would compliment a defense attorney.

I took issue with your advice to give a brief statement. If I were an expert witness, like yourself, I might feel confident enough to do so. As an average citizen I am not comfortable standing on my own, in possible opposition to a team of professional law enforcement officers trying to close a case.

You mentioned through clever questioning, a detective on the stand can let out that the accused invoked the fifth. That's what judges are for, to uphold the spirit of the law and prevent prohibited evidence/info from entering on a technicality. As a non-lawyer, I would suppose a good defense attorney could conference in private with the judge and DA and have the judge enforce, that in no way, is the accused using his rights granted under the BOR, to be revealed in open court.

In closing I'd like to say I find your advice to the general public, to speak up without an attorney, to be...

Great advice.
I've served on juries for two different assualt trials. Jurors definitely pay close attention to initial statements made to LEO by defendants, witnesses, etc. before they've had time to consult lawyers and concoct elaborate stories. Having a statement in the police report that you were in fear for your life is invaluable. Simply stating such in the court room six months after the fact is much less convincing. Jurors frequently view lack of cooperation as a sign of guilt. Impressions go a long way.

No offense taken. Differing opinions are ok on the internet. Everyone can and will form their own opinions based upon a wealth of knowledge available. I make an argument for my own stance based upon my knowledge and dare I say expertise.:)
