you can ccw in your own house and you should...

it's just makes sense. You protect yourself when you are away from your home, why wouldn't you at home?

CANNOT legally have a loaded firearm in plain sight of a public road, public place or public highway

According to 417f, "brandishing" only applies
to any of the following:
1-a public place in an incorporated city.
2-a public street in an incorporated city
3a public street in an unincorporated area.

417 also sets forth the requirement that the "drawing or exhibition" be in a "rude, angry or threatening manner".
This section was covered during my time at the police academy, and our instructors were quite adamant that it was in fact legal to carry openly a weapon on one's own property, whether in view of the public or not.
However, if you have a section number, please let me know. I do try to keep up to date on all the criminal codes of my state.
 
Actually, 417 is the section I was also loosely referring to. I forget that some parts of California are quite rural (my fault entirely).

Down here in the well incorporated areas of South O.C., it can be construed as being illegal since you are "displaying" the loaded firearm in plain view of a public street in an incorporated area.

Even if you wanted to parse words with the LEO regarding "plain view" and "public street", a lesser charge of disturbing the peace could potentially be applied. In the end, it's up to the D.A. to decide whether or not to pursue the issue. :rolleyes:

I also forgot to mention in my original post, "I am not a lawyer nor do I play on on the internet". I do have a very good relationship with many of the OC Sheriff deputies that patrol my area and we like to chat about firearms related subjects quite frequently.

Nothing I have mentioned is based on case law, it is all simply anecdotal and your experience may vary.

Ah, of course. I must say, this, IMO, is one of the most abused statutes in today's society, particularly in regard to RKBA. Whenever somebody dislikes the actions of another, this is what pops up. Our society has this sick idea that people somehow have a right to not be offended.

I do not carry in my home currently.

As for whether or not I will in the future, I cannot honestly say at this
point. I did receive my first gun recently and it is a pistol, so I could
if what 45cal posted is correct. Perhaps after I get some real shooting
experience I will reevaluate my position.

Goodness knows I have reasons (live in a gang infested neighborhood).
I'm out of here by December, but for now, they don't tag my stuff, nor bother me.

I have mine on in-house, out-house, all around the house. I have a fire extinguisher too, lock my doors, and have GFI breakers. Guess I am really a mental case. I just built an un-attached shop/garage for my truck and the ATV, lawn tractor and the big tractor. I will be stashing a weapon in there too, probably a Mossy 500. I am at least 20 to 30 mins. from a county mounty being able to be at my place. HD falls to us.
