Mayor voices outrage over court decision striking down gun ban

The mayor of the nation's capital says he's "deeply disappointed" and "outraged" by an appeals court decision today striking down a long-standing Washington, D-C law against owning handguns.

The court rejected the city's argument that the Second Amendment right to bear arms applies only to militias.

Mayor Adrian Fenty says the decision "flies in the face of laws that have helped decrease gun violence" in the city. He says the city will appeal -- and that in the meantime, the law will be enforced.

The handgun ban went into effect in 1976.

Okay, the law has been struck down, squashed, found to be unconstitutional.

But Lord of the Ding-a-lings plans to continue having it enforced.

Wonder how long before the idea of arresting someone for violation of a law that is no longer constitutional will set in...
 
I was curious about this. Legally, does this ruling mean the residents of DC can begin arming themselves immediately or do they have to wait for a final decision after it's appealed?
 
As it stands, this court has jurisdiction over the area where the ban was enforced, they have found it unconstitutional on its face, stroke of the pen and its gone... Poof!
 
Any moron that continues to arrest and prosecute

in spite of this ruling should be tried for violation of constituitional rights. Period.
 
Well, how do you legally buy a gun in DC? There are no gun stores that I know of, and you just can't waltz over the VA or MD and buy one as an out-of-stater.

EDIT: I searched AuctionArms, and they have no FFLs on file in DC.
 
Dear Mayor Fenty,

The District Court has overturned the ban. This means the U.S. Constitution still means something. Put on your big boy pants and deal with it!

However, let's wait and see what he has to say after he's sobered up, and his District Attorney's had a chance to talk to him. ;) :p :D

I think this is very interesting.

Like driving through NYC with a pistol in a locked container in the trunk.
Get searched (for literally anything) and they lock you up, even if you have hotel reservations in New Hampshire. You bitch and bitch, and eventually they let you out. Are you compensated after you're fired for missing a conference?
Probably not.
I'm bringing my gun to DC either way.

Is it not illegal to enforce a law that no longer exists?

edit: I guess that is of no matter considering the law was illegal to begin with...:rolleyes:
 
just like pot in california

we voted and cops didnt like we made it legal.

so police still very often enforce non existant laws.

looks like DC will go thruogh the same test.

result here- clogging of courts that always dismiss charges.

mayor can say whatever he wants, it's what the JUDGES say that matters

Maybe Fenty plans to request a stay until his appeal goes through?
And where was this outrage a month ago, when Marion Berry was publicly seeking a temporary amnesty?

No - you want perfect? Have SCOTUS deny cert or uphold the decision, and THEN let him say this.
Last time that happened, they sent in the Nat'l Guard. How cool would that be?

So if I move to DC (hahahah) and have my fully assembled long guns and hand guns in my apartment. Announce it to the cops and tell them to come get me.

They come get me. I get my lawyer to go to the court and the judge to issue a court order of estopal. They don't stop so then we can have the mayor locked up for contempt? Not that DC mayors are in strangers to jails or anything....

A super unlikely chain of events but is this possible?
 
The judge should send a federal marshall out to throw the mayor in jail for contempt of court (I tried to figure out some way to say "throw his ass in jail" without an ambiguous antecedent, but couldn't).

Call the mayor a waaaambulance. Want some cheese with that WHINE? It sucks to lose, but you lost. Cry me a river, build me a bridge, and GET OVER IT!!!

I'm a little miffed. My apologies to all I've offended.

I'm with you brother! For years the people in DC have been blaming THEIR crime problems on the criminals "crossing over into MD and VA, and buying the guns and bringing them into DC..."

Quite possibly, Mayor Adrian Fenty will be sharing a cell with (former) Main Man Mayor Marion Barry, if he defies the Judge's ruling.

Barry's VERRRRRRRRRRRRRRRRY close to spending some more time in the jail cell hotel for income tax evasion; violation of probation and creating a public nuisance. Oh wait, the public nuisance won't hold up. Strike public. He's just a nuisance.


I'll go stand in the corner, now.:evil:
 
What's amazing is that Mayor Fenty is a LAWYER and yet he somehow is having difficulty reading and understanding a simple contract clause here.
