I was delayed tonight in the NICS check for a S&W 10-7 (Royal Hong Kong Police version) I won at GunBroker auction. This is the 3rd 01 FFL purchase I have made since the "shutdown" and didn't have a problem with the other 2. I was delayed once before on a Saturday afternoon about 3 years ago when buying a 10/22 at a WalMart. I've had a C&R since April and make about ten to fifteen 01 FFL purchases a year. For the past several years every purchase I have made is sent to "further review" but approved with in a couple of minutes. Is it possible that while the BATFE is "open for business" during the shutdown their budget has been reduced causing delays?? It was about 5:45 EST tonight when this happened so I will have to wait for the dealer to call me when I can pick it up.

BATFE doesn't do NICS. NICS is operated by the FBI. Not to be confused with NCIS which is run by the Navy.
 
It would be interesting to see if this is an isolated case, or is happening to other members. I would suspect that it's the government's way of making everyone feel the impact of the shutdown. I bought a new shotgun just before the shutdown because I thought I might be delayed.
 
I work at a LGS and we are not seeing any difference. Delays have lots of reasons, most of which have nothing to do with the buyer, IME.
 
I bleieve the NICS checks are done at the FBI facility in Clarksburg, WV and it was about dinner time (I'm in WV too). My checks always need "further review" and the last time I was delayed it was on a Saturday afternoon - a time when there might have not been someone available to complete the review. Does anyone know what happens at "further review"??
 
Retiredusnchief, A few years ago I was walking with my family on the embarcadero in Seaside, OR. My elderly mother needed to sit for awhile so we found a bench. A small engraved plaque on the bench said "Group W". I cracked up, no one else got it. Whatcha gonna do?
 
I'd love to know why every NICS check I do is sent for "further review". Most of the time it is approved with in 2 minutes even during the deluge of sales in January. This time and the time a couple years ago where delayed I think it is because there was not an ageant available at the moment to approve it. My research so far indicates there is something which puzzles the computer triggering the review. I notice there is a place on the form for a 'Unique Personal Identification Number" - does anybody know if this is something I could apply for and get or is it issued by FBI or ATF only when there is a problem? Also I might look into getting my CHL. I was reading about some changes in WV gun laws recently signed into law by the governor that among other things waves the NICS check for CHL holders but I have to confirm that and it may not be in effect yet as the bills were passed and signed late in the spring.

I have only had one check go "pending". It was all my fault and just so you don't do it, they tend to frown on buying 8 guns in an 8 hour period. 7 was OK, but not 8.

Catch the reference? Brother, I have the album. Remember those? Large, flat vinyl things. Dang, I'm getting old......
 
To bad the West Virginia ccw permit doesn't exempt you from the NICS call. It was nice not having to worry about the phone call with the last gun I bought. Maybe work to change your states laws?

There is a 3 day wait for pistols, 5 for long guns (which is weird) but according to law they have to let me take said firearms after 3 (or 5) days in which I do. They just never call back. Don't get it. All they do is take a copy of my DL and CCW with regular paperwork.

When FBI NICS runs your name, date of birth,etc, multiple records are returned. Your name or one very close to it is shared by someone who is a prohibited person.

The customer service rep who takes the initial call is not authorized to make that decision, so they forward the call to an FBI NICS Legal Documents Examiner. (when calling NICS the dealer has to repeat the status given back to the CSR)

The examiner will compare your information vs the records returned from their database. Usually, this takes less than a minute. If the examiner cannot complete the call in a timely fashion, they will tell the dealer "This transaction, XXXX-XXX will be delayed while NICS conducts additional research. The Brady Law does not prohibit the transfer of this firearm on (date)....my name is XXX and my Brady ID is 12345"

When the call to FBI NICS results in a delay, the FBI has three business days, beginning the next business day, to deny the sale or transfer. They will give the dealer the exact date the firearm may be transferred.

There is no difference between a delay for handgun vs long gun under Federal law. (your state may have a more restrictive law)
 
Picked up two since the shutdown with no delay, which I guess means the FBI is not furloughed. The only thing I've seen is that BATFE is not answering public calls to check on the status form Forms 1, 4, etc.
 
After many years of buying MANY dozens of firearms with using 4473's I have hit a tipping point. The last three firearms all have been delayed by a day. Just so there is no saying I must have a person with the same name that is a problem---this. I use my name (that is reasonably unique), birth date/place, address, and SSN----none of which has changed in 25 years. I have not defaulted on a loan, no speeding ticket, or anything else to put me on a radar of any sort that I am aware of. Unless someone has my IDENTICAL info down to my SSN and they have caused a problem my status should have NOT changed. I have used a credit card to buy good amounts of propellant and primers the last few years---but.:banghead:

Most of those that were delayed that I have talked to did not use their SSN when filling out the 4473 so an ID issue could have happened to them and I always felt that using mine circumvented those problems but now I wonder about that. Worrying about me is a waste of time IMHO as I am so predictably boringly the same as I ever was.:rolleyes:
 
I ran into this about 6 years ago when my Dad passed (I am a "Jr.") and the FBI told my LGS they were selling to a deceased person and to check for fraud. I took the time to point out the SSN and DOB and after about 3 mos. it stopped.
