Why the delay??

    I have purchased many handguns from many different local gun stores. My first few purchases ended up in delays. I then got my UPIN and have had no delays since. I have bought up to 7 different guns in one store, 7 from another store, and maybe 5 in another store. I always walk out the store with my new purchases. Then I tried this new store. I bought a transferred firearm fom Buds about a month ago and I had to go back hours after to pick it because of a delay. I just came from that same store 2 hours ago to transfer another Buds long gun to me - also a delay. I just called them to find out if they called back or if NCIS called back. They told me that they wait up to 24 hours before NCIS calls. I was only the one with delays, there were at least 3 other on the delayed status.

    I am obviously impatient, but I was wondering, does NCIS have preferences to stores, do store employees do not know how to call in a NICS back ground checK??

    I have found that time of day and season have something to do with it. If I go, in the middle of the day NOT around the holidays they report "Additional Investigation" or something and my guy just waits on the phone... then it is always a proceed. If it is a Friday afternoon before Christmas... they do not have time to do the additional investigation.

    Thats my theory...

    Altho i dont have a UPIN and been meaning to get one id be rather upset to get a delay. Unless i had something in my life legal wise pop up in between now and the time i got the UPIN.
    I tend to have a 33% delay chances even tho im standing there talking to the saleman with my 1911 on my hip as i have my ccw and i cant buy a .22lr bolt action rifle on the spot.
    But i do feel background checks are necessary, Its just the delays that make no sense what so ever that irritate me. I in no way condone gun regulation or registration, But we do need measures to keep criminals from buying a gun in 5 minutes.

    I got a UPIN only to find out it doesn't help if your "flag" is popping at the state level. I found out my 100% delay rate is because there's a dirt bag out there with the same last name and DOB. It takes a real human being to look at the rest of my info and decide "hey, this isn't Dirt Bag" and get my approval. I wish UPIN worked for state delays...

    If it helps ease some frustration you would not believe how many soldiers get delayed. I've seen general's get a delay, I know that is really crazy but it happens a lot. I've also seen quite a few LEO's get a delay and they're in uniform so who knows what they think, I have found doing your check online stops a lot of delays.

    How do you exactly do that?

    I just found if weird that this particular gunstore, actually it isn't a gunstore but a Gun dept. in a generala store - Griggs, that I only get delays.

    I used to have that problem... except in small town ND you wait dayS, not a day. And, that was with the Local Deputy owning and running the gun shop.

    He got tired of it and started pushing Concealed Carry Permits on all his regular customers. End of problem!! You walk in, pick out a gun, fill out paper work, write in the Concealed Carry Permit number, walk out with your gun... No phone call, No waiting period, No confused with someone else, even if you don't use it, it's worth having it.

    Yep, just another good reason to get your CHL/CWP/call-it-what-you-will...

    Only 18 states have permits that qualify.

    I have a CCW. We call it a concealed pistol license (CPL) here in WA. My wife wanted me to choose my Christmas gift this year and is paying for this GSG 522. Since it is a long gun, I didn't have to use my CPL.

    I can just bet this empolyee read my info wrong. This happened to me once where another LGS read my "S" as a "5" with my UPIN and had a delay. I called to ask if NCIS called back. She called them back and I received an immediate "proceed" with the corrected UPIN. Now this store employee (the one I am waiting on right now) actaully got annoyed with me when I called them back to ask if they could call NCIS again. Obviously, he didn't know his business. This is the longest delay I have had since I received my UPIN. Anyway, I am confident I will get it...soon, so I bought a cheapo Tasco red dot sight from Walmart.:D

    If the store you buy from has internet they can do your check online. The biggest cause for delays are

    1- military and LEO
    2- you do not provide your social
    3- common name (smith, jones, etc.)
    4- the guy calling in doesn't give the information correctly ( it happens we all have those duh moments)
    5- you have had a past less than perfect
    6- the Fed employee types something in wrong or just doesn't feel like letting you have the gun, think body cavity search at the airport- like winning the lottery cept you lose,lol

    There are a million reasons for a delay and you are not the only one. I have bought plenty of guns and never been delayed but it could happen anytime. I work in a gun shop the owner has been delayed before, go figure.

    Having a CPL does not mean you can't be delayed on a NICS check. Sorry.

    so a clerk at NICS decided one day that he/she was not going to allow you to purchase a firearm? :rolleyes: can't wait to hear you explain this one :rolleyes:

    I'm almost always delayed at least a couple of hours. The times I'm not I'm shocked. I've simply learned to expect it, and not to fight it. I just leave my cell phone number and my wife and I go out to dinner. I'll get a call before long to come on back.

    In 18 states, it means no NICS check at all.

    I delayed about everytime. Sometimes they resolve it on the phone, othertimes I get called back. It sucks too because I have to drive 1.5 hours to pick up my saiga .223 in a couple of weeks and I may very well get there and find that I will have to turn around and drive home.

    I am going to look into shipping, it may be cheaper.

    It is furstrating when you get a delay when you know very well that you are clean and that you have a Glock36 on your side. I will pass by the store this lunch time. I am quite sure that the employee either gave the wrong information or did not give my UPIN at all.

    Actually I never meant won't let you have a gun but they can delay if they want to, just like a firearm shop can refuse sale or delay you even if the check clears you. Errors can be called accidental be sometimes they aren't.

    a. The system is down

    b. Two people called in sick

    c. There's a staff meeting

    d. Everybody went Christmas shopping or it's the opening day of deer season


    I figure it's just like any other work place. Stuff happens.

    Why would a UPIN (Unique Physician ID Number) give you any more status in buying a firearm ? In the BATFE Times (not online), there was a study on false and positive delays. The study showed that due to very tight filter controls on the background check, that they get upwards of 87% false hits due to same name, close to address, same military history, false hits on felony and other issues.

    In my state (Ohio) if you get a delay, you can automatically pick the gun up in 7 days if no issues related to you are found.

    You can request a FOIA (Freedom of Information) to get why specifically you were delayed. With that you could possibly work on getting what ever info is causing your delays corrected or relieved.

    I have had an issue with a delay in the past before I received my FFL01, due to another person with my name (diff race) was a felon that had escaped a jail in Tenn. Now that I have my FFL and C&R, that I still get a delay when I find a gun somewhere else, due to the same issue.

    I tried to get it all cleaned up, but until he is caught, I will always get a delay.

    I think you meant to say unique PERSONAL identification number. Though, I am a unique physician in my own way - I am a pediatrician.

    Well, I got my gun this lunch time!!:) The employee, who called it in yesterday, did not give my UPIN.:scrutiny::fire: I spoke to another employee, who happenED to know me and who happended to have sold me a gun last month, and asked him to make the call. After 10 minutes he returns and gives me the proceed. I knew that guy yesterday was new and maybe a little slow. The thing was I had to fill up another 4473 form since the yesterday's one was invalid.

    Anyway, I have a happy ending.:D

    NICS doesn't ask for rank or job (I've had a church pastor get delayed):D


    FBI NICS is a very efficient, polite and professional operation. Their promptness in answering leads me to believe they have hundreds of customer service reps taking calls. In the last two years I've heard wait music only three times (two of these were for less than thirty seconds).

    The FBI NICS call center is open 17 hours each day, and every day but Christmas. Those hours are only beaten by WalMart and 7-11.

    That was my point about the general anyone at anytime can get a delay.
