Elderly clerk in liquor store kills assailant

A Tell City, Ind., man died early Friday morning after attempting to rob an Evansville convenience store.

Police said Charles Dale, 31, walked into Kwik Stop Liquor, 932 W. Columbia St., and started "beating on" an elderly female clerk. As he assaulted her, he allegedly demanded money from the register.

"In defense, she fired a gun that she had on her," said Evansville Police Detective Kevin Mason. "He was hit more than once, (and) she was hit once - she thinks she shot herself, (because) she was trying to fend him off, and he was still beating on her when she was trying to shoot him."

The woman, whose name was not released, had a permit to carry the gun, Mason said.

After the shooting, Dale fled the store with some cash and two bottles of liquor. A passer-by saw him leaving, and went into the store to check on the clerk. When he found her bleeding on the floor, he called 911.

The clerk was taken to St. Mary's Medical Center, where she remained in serious condition Saturday.

Along with the gunshot wound, she had several bruises from the assault, Mason said.

"He was a pretty good-sized guy - about 6-feet, 1-inch and 240 (pounds)," Mason said. "And, here, she's 60-something years old and not real big - he did a number on her."

Meanwhile, Officer Keith Smith and his K-9 partner, Kolja, were called to track the suspect. They followed his track out behind the store, where he lay in the alley with the stolen cash and liquor spread out around him.

"An ambulance was called," Mason said, "and they transported him to Deaconess (Hospital), where he was pronounced dead."

Police said the investigation is continuing, and a case file likely will be sent to Prosecutor Stan Levco.

He then will decide whether to pursue any charges in the shooting.


If the situation is as described, I doubt that Levco will file charges.

Even if he did, I can't see a jury in this are voting for conviction, nor can I see many people voting to re-elect the Prosecutor.

The store's name used to be Mr. Liquor. :D

I can see it now:

Pan camera to DA's office; zoom in, key mic....

DA - How dare she kill that man! All he wanted was some booze and a little spending money.

Assist DA - But sir it wasn't his - he was stealing it and he did beat up a 60 year old woman.

DA - Only because she resisted. When will the sheep ever learn. It's not up to them to resist. Their lives are ours to protect not theirs. And since when is a man's life worth just a few dollars and some booze?

Assist DA - well sir that is what he decided it was worth when he chose to rob the store...

DA - WHAT! You better watch that young man! You're beginning to sound like one of those freaks who believes in personal responsibility and individual freedom. With an attitude like that you won't go far in government.

Assist DA - uhhhhh - sir - this is the United States of America...

DA - you're damn right it is and that's why it's time we reminded the sheeple of just who's in charge. File charges against her for unlawful discharge of a firearm inside city limits, assault with a deadly weapon, disturbing the peace, destruction of private property, unlawful appropriation of government funds (hey she took up my time right), murder 2 and anything else you can think of. We'll teach 'em - we'll teach 'em. Oh... and don't forget to bill the old lady for all the cop's time, yours and my time, medical personnel time, the funeral of that poor man she shot and what ever else you can - that ought to swell the city's coffers a bit - she's probably one of them anti-tax republicans anyway.

This is Evansville, Indiana, not New York City. :p

I doubt she'll be charged with anything more serious than leaving trash in a city right of way. :D
 
My heart dropped when I read that someone called an ambulance on behalf of the perpetrator. Then I came across the part where he was pronounced dead. What a relief.
 
Dirty little justice system secret: Charles (Chucky) Dale was out pending sentencing for prior crimes. He had been sentenced to five years in prison, but was supposed to show up in court to serve his sentence on Friday November 07, 2003 (which was the day this incident took place). Surprise he didnt show up to serve his sentence. Someone needs to ask a Perry County Judge why he was out instead of already off to prison. This is the second time the Judge has let someone out pending service of his sentence and the offender has commited other serious crimes.

If you wonder why I know so much about this case PM me and Ill tell you why.
 
Sounds like a good shoot to me. Got to respect the lady for getting a few shots off while being beat up and obviously under stress. Ma'am, I tip my hat to you.

It's too bad she might have shot herself during the event.
But it is great she took a BG off the street.

I wonder where she shot him exactly... Center of mass shot?
Hit a major artery in his leg, and bled to death? Hmmm...
Maybe both?

I don't think she got him with a head shot, being that it appears he did'nt have any brains to begin with. Now, if she shot him in the keister...

Beretta .32 in a holster.

The first bullet went through her and into suspects left thigh. The second shot went into his left chest and the third shot struck the center chest.

I spoke to our technician who was there for part of the autopsy. She is not a gun person and didnt ask what kind of ammunition was recovered.

That sounds like a definite!!

Pity this lady got hurt herself ... 6 foot of 240 lb BG is no easy thing to ward off ......... but .... now at least this will save the taxpayer a bunch of Dollars ... burial is much cheaper.!;)
 
A .32 will kill them. It won't always stop them cold, however.

Of course, that's also true of most any other handgun.
