All,

I was just reading Fark when I came across this article about a bill that the New Hampshire state legislature is looking at passing.

New Hampshire Resolution Immediately Voids Several Federal Laws, Threatens Counterstrike Against Federal “Breach Of Peace”

The New Hampshire state legislature took an unbelievably bold step Monday by introducing a resolution to declare certain actions by the federal government to completely totally void and warning that certain future acts will be viewed as a “breach of peace” with the states themselves that risks “nullifying the Constitution.”

This act by New Hampshire is a clear warning to the federal government that they could face being stripped of their power by the States (presumably through civil war!

The remarkable document outlines with perfect clarity, some basics long forgotten. For instance, it reminds Congress “That the Constitution of the United States, having delegated to Congress a power to punish treason, counterfeiting the securities and current coin of the United States, piracies, and felonies committed on the high seas, and offences against the law of nations, slavery, and no other crimes whatsoever;. . . . . therefore all acts of Congress which assume to create, define, or punish crimes, other than those so enumerated in the Constitution are altogether void, and of no force;”

Federal gun crime laws? Void. Federal drug crime laws? Void. The gazzillion other federal criminal laws that deal with anything other than the specific enumerated crimes? ALL VOID.

Unfortunately, The Manchester Union Leader has not picked up this story, so hardly anyone in NH has even heard of this bill and thus can't call their state reps and senators to support it!

You know what to do.

This is simply amazing as this is has amazing implications.....and while I do not think that other states are going to back this, this is just awesome that a state has the balls to step up and say something like this.
 
New Hampshire is now on my list of places to live when I retire.

i hope this passes. it would be the frist step in the right direction in quite some time
 
I believe Arizona and Oklahoma did or attempted to do something very similar. Basically, the resolutions that did or did not pass (don't know which) basically said, "Hey, Fedzilla, try anything really radical (ie, suspend the Constitution, confiscate firearms, etc) and we'll divorce you!" :D
 
i live in NH and haven't heard a thing.
Not surprised. sounds like a great start, hope it passes.
 
I don't know if this is the 'secessionist' bill the Lightninstrike linked to, but I remember that either that one, or the Montana one was up for its vote on Thursday, February 5th. I would think we'd all be shouting about it had it gone right, but I haven't heard one way or the other.

Does anyone know which and how that vote ended up?

Regardless of what the states do, it's up to SCOTUS to actually decide on the constitutionality.

It's possible, of course, that if enough states pass such resolutions and their elected people in Congress support the resolutions, Congressional concurrence about some laws could result in change.

Don't bet the farm on it, though.

Seven states have had it and are calling on the fed to follow the law set forth in the Constitution.

Would be great to see this list grow to 45 or so since some of the state do not believe in the Constitution.:banghead:

The seven are ARIZONA, New Hampshire, Montana, Michigan, Missouri, Washington and Oklahoma
 
well its nice to see more states joining this list. rather disappointing texas is not one of them though :(
 
not specifically, aside from the bill numbers in the respective states. maybe ask your reps about these specific bills and whether they are doing somthing similar or such
