In a stern rebuke to the city's high-profile crusade against illegal guns, the feds warned the Bloomberg administration that it could face "potential legal liabilities" if it continues to conduct sting operations that fall within the jurisdiction of federal agents.

Wow. Those BATFE bureaucrats sure are tough, aren't they?
 
Somehow, I feel like I have missed something here. Either the BATFE is made up of mental defectives, or Bloomie has a set of big brass ones. You pick. I can't wait for the next chapter in this to play out.

I applaud his tenacity. It is time for Mayor Bloomberg and New York City to show that they run the United States of America. They need to put the federal government in its place. The New York City Police Department is perfectly capable of handling the job of the BATFE, FBI, CIA, DEA, and all other federal law enforcement agencies together. Mike Bloomberg will show them how they should have done their jobs. Mayor Mike is The Man.

Does any know if there's any truth to the rumor that one of the Mayor's sayings is "If you smoke, we smoke you"?
 
NOT ENOUGH.
There are many examples of BATF coming down with both boots (literally) on people for inadvertant and unknowing violations. Intentions, or lack of them, mean doodly.
Here we have a case of a person ordering his employees to commit straw purchases. Heck, they've got it on tape! At least 15 times!
Immediate arrests are in order. Violations of federal firearms law, RICO, and conspiricy charges. Intent to defraud. Interstate commerce.

Equal protection (or lack of it) under the law. Anything else offers clear cause to shut down BATF immediately, and they can't be dumb enough...

Since these dealers are not in New York, can't they, in turn, thumb their noses at NY civil suits? What can Bloomers do, if they just don't show up in court?
 
I'm a lawyer, and they can be sued if they have substantial connections with the state, even if they're not located in it. Even if they don't have those connections but do business with people in NY, NY can have limited jurisdiction ("specific jurisdiction"). If they do things that are directed at and will likely harm the people of NY, NY may have jurisdiction. These would be up to a court to decide and often courts will find there is no jurisdiction. This case would certainly have arguments on both sides.

This not only applies to NY, but any state with a "long arm" statute, such as CA.

If they're sued in NY and don't contest jurisdiction, but let the suit default, then NY can go to their state with a judgment and if their state finds it's a valid judgment their state must enforce it and forward the proceeds to NY.

I still believe that the feds have something going on vis a vis these gun shops and are merely pissed that Bloomberg is mucking with them. If the gov't smells money they're going to go after it.

Don't worry. When Rudy Giulianni wins the elections easily Bloomberg will get his medal of freedom and all the laws passed instead of the 20 or so new gunlaws we seen passed in the past 6 years.
 
Honestly, I don't think that ATF is upset about Bloomberg and his actions. I think that they are upset that NRA, 2AF and whoever else put so much heat on ATF about this that they finally had to do something. And their something of a letter is essentially nothing.
ie We're not going to punish you know Mikey, but if you do it again....
