Ok so after all these years I thought I pretty much had this law figured out and knew all the ins and outs of it. Now recently I was reading another forum and someone stated that with the NJ law the "feature ban" of the pistol grip, flash suppressor, bayonet lug, etc. can only be enforced on guns that are specifically listed. He went on to say that a gun that was not on the list such as a Robinson M96 could have every evil feature and be perfectly legal. Somehow this does not sound right to me and I'd be very leary to try out that arguement.

My other question has to do with HK91 and HK94 series of rifles. Since the post-ban bushmaster and MAK-90 rifles are legal in NJ based on the State AG's letter and the fact that they don't have the evil parts what about rifles such as the PTR-91 and MP5 clones that are a totally different name than the HK94 and not on the list? By my calculations they should be legal, but when it comes to this state I'm never quite sure and since I have yet to see either in a gun store I figured I would see if anyone here knows the answer.

You are pretty well informed (which you need to be in order to stay out of the klink in the PRNJ), but this should help you out a bit:

http://www.njsp.org/about/firearms.html

BTW, I'm a refugee from the PRNJ, having escaped about 3 1/2 years ago after having lived there for about 38 of my then 40 years. I have a cute story for you: on my way out my wife and I went over the DMB. After safely passing the "Welcome to Delaware" sign, I casually turned to her and said, "Now you won't have to bail me out of jail." Naturally, I got the desired bug-eyed and open-jawed look, followed shortly thereafter by "Wha, Wha, WHAT! are you talking about?!" I explained to my NJ-gun-law-naive wife (she's from Mexico - completely legally, BTW - and didn't know squat about any gun laws then) about the absurd magazine limits. She then asked me how many I had, and I told her that I had about 200 years worth of prison time sitting less than 2 feet behind me. More bug-eyes, etc. - and then an explanation of the penalties (as you know, its up to 5 years per "illegal" spring-containing, stamped-metal box). She then got a look of absolute disgust on her face, muttered something about "stupid Gringo pendejos" and asked me if they had any laws like that in Texas. I told her, "No, Texas is in America."

Oh, and I didn't bother telling her about the several hundred rounds of hollow point sitting right next to the magazines. :what:

Given the above, and what you know about the extraordinarily hostile environment for gun owners there, you may understand my reluctance to ever live in the PRNJ again. Besides, I don't much feel like giving up my carry license.

Wow as I read through that NJSP site it seems that the other guy was right. I can't believe that I never picked up on that before.....I always prided myself with being able to carefully interpret laws.

A semi-automatic firearm should be considered to be “substantially identical,†that is, identical in all material respects, to a named assault weapon if it meets the below listed criteria:

A. A semi-automatic rifle that has the ability to accept a detachable magazine and has at least two of the following:

1. A folding or telescoping stock
2. A pistol grip that protrudes conspicuously beneath the action of the weapon
3. A bayonet mount
4. A flash suppressor or threaded barrel designed to accommodate a flash suppressor
5. A grenade launcher

That would definately lead me to believe that the PTR-91 and the many clones of the MP5 such as Special Weapons and the like are legal in NJ!!! Wow!!
