FFL and ATF interaction

While at my local gun shop today I heard/spied/eavesdropped on a conversation between an ATF agent and the owner of the gun store. The whole conversation doesn't matter, but the bulk of it is explained in the point below.

-According to new ATF regs/statutes all employees of a business with an FFL must be fingerprinted by the ATF and kept on file while they are working at the FFL.

This is new to me because I have worked at an FFL before and didn't need to get fingerprinted, so it must be a new regulation.

Any news on this or am I the first to hear?
 
A friend of mine just got his FFL and I asked him what they said about employees. The BATF agent who interviewed him said there was no restriction on employees but he was responsible for them getting the paper work right. I wonder if there are differences between agents by region. The agent told him if he was trying to follow the rules there would be no hassle if a minor mistake was made. Just help to correct it. This is a little different from what I had heard from other dealers.

If the license lists more than one "responsible person" (someone who directs the business's management or policies), then each of them must submit prints and photos. These names will appear on the FFL itself.

Employees are not required under Federal law to submit prints or photos. (Your state law may differ)

Walmart doesn't list all eleventy billion employees on their FFL's.

Lock your doors and change your appearance. You violated Title 18, United States Code, Section 1001-a. To wit, eavesdropping on a federal officer with the intent to lie to said officer!:rolleyes:

I have an FFL and have not heard of this one. Anyone whose name is on the license is fingerprinted and checked out by ATF. Mere employees are not.

Some states do have their own separate requirements regarding fingerprints and background checks to be an employee of an FFL. The ATF inspector (not agent) should be aware of the state's laws in his or her territory and will apprise the FFL of them.
 
Well the surprising part is that one of the employees whom I have seen there for a long time, he is very black helicopters-ish, was very angry and saying he wanted to see the law in writing that made him have to submit to these things....but a mere regulation wouldn't be a statute. I am in IL by the way but would a federal agency change operating regulations state to state?
 
Yep. If their names actually go onto the FFL, they need to submit it all. General employees however do not.
