FFL won't ship or refund.

Long story short; a dealer refuses to send my rifle or refund my money. We had an argument over my FFL dealer and he got mad and now refuses to send the rifle or refund my money. Does this violate any FFL rules? Is this something the ATF would handle or is it simply an issue in small claims court? What are my options? Thanks so much!
 
What money are you owed - a transfer fee, or money for the purchase of the rifle?

Money for the purchase. I told him if he doesn't want to ship the rifle, then I'd gladly take a refund of my money. He then told me no and to stop contacting him.
 
First how did you pay? If you used a credit card or check contact your bank and file a claim. If you used a Debit Card you may well be out of luck. Money Order or Certified Check are also likely lost. In those cases it is a matter for the courts and you need to decide if the loss is sufficient to justify legal action.
 
I paid for the rifle with my debit card. When asked why he wouldn't do one or the other, he told me I was being impossible.
 
That's theft. Personally I always pay with a credit card, and if the seller won't accept credit, then they can have a nice day.

Sorry for your troubles. Small claims court sounds like the route for you, but it really depends on the cost if it's worth it.

This is also why I tend to communicate via email. It provides documentation that will not be had in a phone call.

I have all the emails. Everything. Receipts, invoices, you name it.
 
I haven't contacted anyone on the federal level, but I'd assume that the ATF would be able to help. It's straight theft. No two ways around it.

Awesome! Sounds like you might want to file suit then. If he took your money and refuses to ship to a legitimate FFL, it sounds like theft.

What exactly is his problem with your FFL dealer?
 
I'm not sure I understand the situation. Am I correct in that you bought a rifle on line from an FFL and he refuses to ship it to you?
 
Ok, so I bought the rifle online. Placed it on layaway. Paid it off. When it came time to ship I gave him my FFL dealer's info. He told me I had to have my FFL dealer contact him. I told him he had his info and could contact him because he'd have to give him his FFL info. Turned in to an argument and now, here we are. He got mad at me over it and now refuses to ship the rifle or refund my money. Simply told me not to contact him anymore. He told me that I was impossible to deal with and he wasn't putting up with my "dealer's BS" anymore. He hasn't been in contact with my FFL dealer once. Not once. My dealer never got this guy's FFL info or anything. Zero contact. Hand to God, that's the complete and honest truth. I've threatened legal action and he just says, "do whatever you think you need to do."

Here's the catch. I'm in Missouri. He's in Georgia.
 
I'm confused, it sounds like the issue is with the firearm dealer not the FFL? Did you order the gun online and is it in another state? If so, I would report to the ATF/FBI, if it's instate report to the state Attorney General. It appears you argued over who the firearm dealer was suppose to send the gun to (the FFL). The firearm dealer owns you the gun, you can pick a different FFL, or a refund. They just can't keep your money.

There's no issue with my dealer. I use him all the time. The issue is this guy is just being an ******* because he got mad at me. I'm now looking for advice on what to do.

Sounds like theft to me

Not sure if you can involve the post office as you didn't send the money by post, but it would be worth a try. If it's been going on that long, time to involve the authorities.

Suggested next step. Politely ask your local LGS to send a copy of his FFL and a request to ship the rifle.
