'Grand Theft Auto' Makers Fight Lawsuit

KNOXVILLE, Tenn. - The creators of the video game series "Grand Theft Auto" want a federal judge to dismiss a $246 million lawsuit filed by the families of two people shot by teenagers.

Rockstar Games and its New York City-based parent, Take-Two Interactive Software, said the victims' families were trying to hold them liable "based on the expressive content of the video game."

Retailer Wal-Mart and marketer Sony Computer Entertainment America Inc., are also named in the lawsuit.

Aaron Hamel, 45, was killed and Kimberly Bede, 19, was seriously wounded when their cars were hit June 25 by .22-caliber bullets while driving along Interstate 40.

Stepbrothers William Buckner, 16, and Joshua Buckner, 14, were sentenced in August to an indefinite term after pleading guilty in juvenile court to reckless homicide, endangerment and assault.

The boys told investigators they got the rifles from a locked room in their home and decided to randomly shoot at tractor-trailer rigs, just like in the video game "Grand Theft Auto III."

Responding Oct. 29 in U.S. District Court, Rockstar and Take-Two contend that such ideas and concepts as well as the "purported psychological effects" on the Buckners are protected by the First Amendment's free-speech clause.

A lawyer who represents the victims dismissed the claim, saying he would seek to move the case back into state court for consideration under Tennessee's consumer protection act.

Somehow this strikes me as rather silly. Wal-Mart getting sued, much less Sony for making the computer itself! Why not blame the mining companies that produce gravel, which in turn makes a lot of dust, that settles on the keyboard that the dumb kids were touching while they played the game! :barf:

Do video games promote violence? Probably.
Do video games glamorize violence? Definately.

What a JOKE !!!! There is a clear cut difference between reality and a video game. :rolleyes: Send the little punks to jail and dismiss the lawsuit. Just like Camel said, If video games cause people to forget consequences for actions, then I would have been dead a long time ago.
 
There are also accusations that the game is racist...your instructions for one mission is KILL ALL THE HATIANS

Bogus. I've played GTA, GTA II, GTA III and GTA Vice City. The BGs in the game are made up of crime families, ie Mafia, Yakuza, Hatian, etc. Through the game, you work for each on your way to the top. You even take assignments from others while still working for one gang.

And I've never got the urge to take a .22LR and shoot at trucks on the freeway after playing any of these.
 
I took over the world as the French in Rise of Nations. The first country I conquered was Germany. :rolleyes:

Unfortunately there is no such mission in GTA III or VC. While trucks, cargo vans, buses, and 18-wheel tractors are present, there are no tractor-trailer rigs in either game (i.e. vehicles with a tractor hitched to a trailer).

Frankly, Rockstar labeled and marketed the GTA series as containing mature content. They have made no bones about it. How the parents and family can then say "we didn't know" is beyond me. The "M for mature" screen that pops up at the begining of the game should have been a clue. Did you pay attention to your kids and what they are doing? If you had you would have seen this after watching what your kids are doing in the game for only a few minutes.
 
I've never played III.

GTAVC IS very violent.

VC IS very racist. I don't see how anyone who played the game can disagree, this game pokes fun at virtually everything and everyone. It's crude. It is also a good game. Really.

It's a junk lawsuit. Really sad that people can even get started with such a silly idea. Where'd the justice go?

Big difference in poking fun and being racist. At no point in the game(s) are you sent to kill someone simply because of their race. The game does not imply that any race is inferior to any other race. Yes, the Italian mafia uses racial epithets (very mild considering the words used in movies) when talking about the Haitians, just as do Asian Yakuza and the white male cops when talking about rivals. Part of the game and part of the real world. There is a reason they're called bad guys.
 
Yeah, I don't think street gangs are as formal and politically correct about one's race and ethnicity as college applications are :D
