United States citizen groups demand federal prosecution of New York's Bloomberg, notes American gun law expert

Gun rights expert John M. Snyder released the following column today:

Over two dozen national and regional groups of American citizens over the weekend
called for a federal investigation of Mayor Michael Bloomberg of New York City.

In a letter to Michael J. Sullivan, Acting Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, the 26 organizations, through the auspices of the Liberty Coalition in Washington, D.C., called upon BATFE “to immediately investigate and prosecute New York City Mayor Michael Bloomberg and his associates for conspiring to violate the federal Gun Control Act of 1968 as amended by the Brady Act of 1995.”

For some time now, the Manhattan gun grabber has been stumping the country campaigning for laws and regulations to undermine if not downright eliminate the individual Second Amendment civil right of tens of millions of law-abiding American citizens to keep and bear arms.

It’s about time he got his comeuppance. In reality, Bloomberg is working against the right to self-defense of law-abiding American citizens, of the very right to life itself. Perhaps this citizen letter to the U.S. Justice Department’s BATFE is a good first step in giving Bloomberg a dose of his own medicine.

“It is well known,” reads the letter, “that Mayor Bloomberg has organized a multi-state vigilante-style campaign against federal gun dealers. Bloomberg’s gambit is simple – without any federal or state law enforcement authorization, he sends people to federal firearms dealers to break federal law by providing false information on the federal ATF Form 4473 firearm transfer form, and then purchasing guns for persons prohibited by law from taking possession of guns (a so called ‘straw sale’). Bloomberg then files a civil lawsuit against the dealer in a New York court while using a covertly made video tape of the transaction to blackmail the dealer into ‘settling’ on terms where the City of New York’s ‘Special Master’ will supplant ATF supervision of the dealer and peruse Americans’ confidential federal gun transfer records at will.”

According to the letter, “Congress’ charter to the ATF to regulate federal gun dealers and interstate gun sales did not come with a command for the agency to step aside when a wealthy New York City mayor wants to break federal criminal statutes and impose New York City style gun control across the nation as a publicity stunt. Moreover, America’s Second Amendment rights are at risk because the ATF has not done its job to intervene in Bloomberg’s travesty of justice.”

The citizen groups tell Director Sullivan that “the ball is in your court. The ATF needs to take action to show that no one is above the law, not even the Mayor of New York.”

National groups signing the letter are American Policy Center, Center for Financial Privacy and Human Rights, Citizen Outreach Project, Citizens Committee for the Right to Keep and Bear Arms, Doctors for Open Government, Firearm Owners Against Crime, Gun Owners of America, KeepAndBearArms.com, Liberty Coalition.net, OpenCarry.org, Second Amendment Foundation, and Second Amendment Sisters.

Regional groups include Allegheny County Sportsmen’s League, Clarion Gun Owners, Lehigh Valley Firearms Coalition, and Pennsylvania Rifle and Pistol Association, all from the Keystone State, FairfaxCountyPrivacyCouncil.org, and Virginia Citizens Defense League, both of the Old Dominion, Grass Roots North Carolina, GeorgiaCarry.org, I Carry Gun Owners Association (www.icarry.org) of Illinois, Kentucky Coalition to Carry Concealed, Ohioans for Concealed Carry (OhioCCW.org), SecondAmendmentClub.org of Land O Lakes FL, Texas Citizens Defense League and West Virginia Citizens Defense League.

Comment: Heard inside ATF headquarters:
(Chief of staff) "Well Mr. Sullivan, how are we going to handle this one?"

(Sullivan): "Are you kidding? Conyers at Judiciary says 'bury it', if we value our budget!
 
It'll never happen. The ATF is for protecting the politicians and stomping on you, not the other way around.
 
Seriously, he's providing all the evidence needed to arrest his minions. Why hasn't Bloomberg been nailed yet? What's he telling these pople taht work for him, and how is one supposed to figure out when someone's lying on the paperwork?
 
The BATFE should investigate Bloomberg if for no other reason than the BATFE- not Bloomberg- has the ultimate authority to go after interstate trafficking.

I bet they do look into the mayor but nothing is done.
 
It's interesting to read their own webpage on the "Settlements" they've achieved.

This is especially troubling...
Under the terms of the agreements, a Special Master has been appointed who will have unlimited access to the dealers' records and the power to impose escalating fines for any new violations of federal, state, or local gun laws.


Just as an FYI, Mayors Against Illegal Guns will hold a National Summit in Washington, DC on January 23, 2007. The program will run from 9:30 AM until 2:30 PM followed by an evening reception.

Call your local ATF office to report a straw sale and then give a description of Bloombergs hechmen.
 
The NRA chose not to sign on. They had a copy of the letter. When contacted by some members(NRA) they were told, it is in the hands of the legal department......
 
I can think of several ways I would like to violate Bloomberg for violating my constitutional rights. Court rooms and lawyers ain't on the list.:evil:

The 1 Feb issue of Gun Week had a page one story headlined SAF, CCKBRA Join Call for ATF Probe of Bloomberg "Sting".

While the idea is truly fascinating, I suspect that BATFE (ATF) action is something that we shall not see, for to expect such action is to forget that such personages as Bloomberg ALWAYS seem eligible for special consideration, after all they ment well, didn't they.

Of course, I could be wrong re the above conclusion, and the ATF certainly could act. Its just that I'm not likely to hold my breath waiting, given that blue is not my best color. I sometimes wish it were, but then add that to a longish list of wishes unfulfilled.

Ah but the poetic justice would be a beautiful thing. There would be a Machiavellian symmetry to it as well.
 
The NRA is trying to get out the word about the problem. I just got my newest American Rifleman (FEB 07). Wayne LaPierre's whole piece is about Bloomberg. Bloomberg spent over $150 million of his own fortune to run for Mayor twice! No, I'm sure he has no agenda and just thought it would be "fun!" Page 10 of the AR.

Is it not a felony to knowingly frovide false information on the BATF form and to participate in a straw purchase? Of course it is BUT like so many of our laws no enforcement will take place until a criminal complaint is filed. How do we go about doing this? The NRA probably won't have the kahonas to do it but what about Larry Pratt with GOA? Since Bloomberg and others are in this TOGETHER what about the RICCO organized crime statutes? Requesting prosecution is one thing but lawfully filing the complaint is another.

Anyone think BATFE will make a referral to the local United States Attorney??

I doubt anything much will be heard from the NRA. As for criminal referrals, don't they have to come from a law enforcement agency?

No, that would be the law, not funny. You and I would be in the pokey for about 10 years. Them, they get to make a point by illegal means.


It would be nice if justice was blind, but lets face it, it's not.
 
Of the "laws" that were violated, how many do you believe are unconstitutional?

How many of you believe the BATFE is an agency that should exist?

How many of you believe that the NY Mayor should be nailed by the BATFE for violating said "laws"?

To me, if you do not believe the laws are just, and you do not believe BATFE should even exist, then wishing for anyone to be prosecuted for violating said laws by an agency that should not exist ... is, well, ... hypocritical.
